Granting of a Conditional Use will require within 3 years for a principal dwelling Land Use Permit to be applied for and the principal dwelling to be built within the permit time frame on the same parcel. Failure to build principal dwelling will result in citation and order for removal of accessory structure Project History & Summary of Request There is an existing garage on the property that needs to be moved in order to build a full time (principal) residential structure. The requested storage building is needed to then store items that are currently in the existing garage. As per conversations with the applicants they are aware of the 3 year time frame criteria to obtain a Land Use Permit from the Sawyer County Zoning & Conservation Department for the principal structure. The CUP is needed to give the applicant additional time to get everything in order. The proposed structure would meet all other setbacks. Additional information for Conditional Use Permits: Substantial evidence means facts and information, other than merely personal preferences or speculation, directly pertaining to the requirements and conditions an applicant must meet to obtain a conditional use permit and that reasonable persons would accept in support of a conclusion. If an applicant agrees to meets all of the requirements and conditions specified in the county ordinance or those imposed by the county zoning board, the county shall grant the conditional use permit. Any condition imposed must be related to the purpose of the ordinance and be based on substantial evidence. The conditions must be reasonable and, to the extent practicable, measurable. The applicant must demonstrate that the application and all requirements and conditions established by the county relating to the conditional use are or shall be satisfied, both of which must be supported by substantial evidence. The county's decision to approve or deny the permit must be supported by substantial evidence.
