Notice is hereby given that on April 16,2019 the Sawyer County Zoning Committee approved the
Conditional Use Permit ri19-021;Randy&Paula Dennis.
Part of the SWl/4 of the NW 1/4;504,T38N,ROSW;Parcel ti032-538-04-2303;20.03 Total Acres;Zoned
Forestry One(F-1). Known as the R&P Earthworks Pit. Permit is desired for the carry forward of
conditional use permit#04-017 for the location of a non-metallic mineral extraction operation,including
rock crusher. The CUP was originally approved at public hearing on September 17,2004 and renewed on
November 20,2015.
Motion by Bassett to approve the application with complying of NR135,DNR Chapter 30,Hours of
operation 7am—7pm Monday—Saturday.Second by Nyberg. All in favor. Mo[ion carries.
Findings of Fact: It would not be damaging to the rights of others or property values. It would not be
detrimental to ecology,wild life,wetlands or shorelands.
Any person or persons jointly aggrieved by the decision of the Zoning Committee may appeal the decision
to the Sawyer County eoard of Appeals to review the legality of the decision within 30 days after the date
of this notice.

Project History & Summary of Request
The carry-forward of CUP 04-017 is for the location of a non-metallic mineral extraction
operation including rock crusher. The property is 20.03 acres and zoned F-1. The existing use is
a gravel pit and forestry area. The Surrounding land use is sewage treatment facility, forestry and
light residential area. The nearest residence is about 580' away.
The Sawyer County Zoning & Conservation Department currently does not have any
complaints for this file.
The current hours of operation are 7 AM to 7 PM, Monday - Saturday. With crushing 8
AM to 10 PM (2 or 3 days every 2 to 3 years)
Financial assurance has been received for $7500 and expires August 25, 2019 in the form
of an irrevocable letter of credit from West Bend Mutual (attached)
With the potential approval of this carry Forwazd the conditional use permit will be valid
for 5 years.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclasion.
If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.

2.2 Operation Development Plan
The sand, gravel and rock excavation operation is projected to continue as previously
permitted. R&P's Earth & Forest Works would like to use this source for construction
and road building projects in the Winter area.
A minimum 50-foot setback will be maintained behveen the excavation and all property
lines. There are no residences within the 1000-foot setback of the proposed
excavation site. The depth of the excavation will be approximately 14 -16 feet. Based
upon the total projected reserves the property may be exhausted in approximately five
years. The number of years is dependent on product sales and available product.
2.3 Operation Activity
The primary operation activity will be the extraction of sand, gravel and rock, and
processing for construction use. The topsoil was stripped to create a berm between
the pit and the Village of Winter Sewage Ponds, during previous use by the property
owner. Equipment used to extract material will consist of an excavator, a dozer and a
skid steer.
Crushing will be dependent on the quality of material extracted, and would occur
approximately once every two to three years for approximately two to three days. The
crushing plant is portable and is easily moved to replenish product stockpiles. During
crushing, the hours would not exceed 8:00 a.m. to 10:00 p.m.
Screening of material may be useful at some time to sort various size products. A
skidsteer would be used to supply material to the screening plant.

2.4 Operation Schedule
Activity at the site will normally occur during the construction season (April through
December).
Hours of daily operation will typically be from 7:00 a.m. to 7:00 p.m., Monday through
Saturday.
2.5 Operation Equipment List and Employees
Equipment involved in the sand and gravel operation is listed below:
Overburden Removal: 1 excavator
1-2 bulldozers
1 skidsteer
1-3 haul trucks
Processing Operations: 1 crushing and screening plant (when needed)
1-2 bulldozers
1-4 conveyors/stackers
2.6 Sand and Gravel Use
R&P's Earth & Forest Works plans to use the aggregate materials for building and road
construction in the Winter area.
2.7 Haul Routes
The primary haul route to be used by loaded trucks from the property will be westward
from the excavation area via Lagoon Road to County Highway W.
The number of truckloads that are projected to leave the site on a daily basis will vary
considerably depending on the scope of work scheduled that day. The most active
months of hauling during the year will coincide with the construction season (April
through December). There will be no hauling during the four to six weeks each spring
when weight limits posted. Also, during the winter months, very few trucks, if any, will
haul from the site.

SECTION 3.0
ENVIRONMENTAL CONSIDERATIONS
3.1 Site Screening
The aggregate excavation and processing area is currently screened from all adjoining
properties by forest products. Existing topsoil berms will be saved for reclamation of
the site.
32 Air Quality
The Wisconsin DNR Bureau of Air Management regulates crushing and screening
operations at the site. The processing equipment will be in compliance with the opacity
requirements permitted under the Aggregate Processing General Permit.
The general permit provides flexibility for using different processing configurations and
various pieces of equipment, depending on the type of aggregate product being
produced. It outlines production requirements, including record keeping, employee
training, malfunction prevention and abatement and fugitive dust control measures that
must be maintained for compliance with the permit. The requirements of the general
permit will be used during the aggregate processes.
3.3 Ground Water
The sand, gravel and rock excavation and processing operation will employ a variety of
screening, crushing and conveying equipment, including excavators and trucks. The
lubrication, and repair practices used to maintain the equipment will be designed to
eliminate petroleum products from ground contact. The Storm Water Pollution
Prevention Plan and Spill Prevention Control and Countermeasures (SPCC) plans
address practices for proper storage, handling and use of petroleum products, as well
as inspection and response procedures. No fuel will be stored on-site.

3.4 Surface Water
The Wisconsin Department of Natural Resources Storm Water Program regulates the
proposed non-metallic mining operation. R&P's staff has attended training on Best
Management Practices (BMP's) for pollution prevention and employs these practices.
The management practices listed in our storm water management plan address
erosion control, and petroleum product handling. With the exception of limited lengths
of the access road and natural runoff area to the east of the road, all storm water and
spring snowmelt water from the operation will be contained in the below grade
excavation, with no runoff leaving the processing area.
There will be no hazardous wastes produced in conjunction with the excavation or
processing operations. Used oil and lubricants from equipment maintenance will be
collected for recycling. Any waste receptacles will be located away from active
operation areas.
3.6 Safety and Health
The United States Department of Labor, Mine Safety and Health Administration
(MSHA) regulates the safety; and health considerations of the non-metallic mining
operation. The site will be subject to annual inspection by MSHA and must meet noise
and dust exposure limits established for personnel employed in the operation activity.
Noise will be mitigated on the site by maintaining functional mufflers and exhaust
systems on all internal combustion engines and by shielding mechanical processes
with noise barriers such as berms and below grade processing.
A 10-miles/hour speed limit will be enforced at the facility to provide safe working
conditions and reduce fugitive emissions. Hard hats are mandatory for all personnel
within the excavation and processing areas. Visitors must have permission to enter
the site and must observe all safety regulations while visiting the site.

RECLAMATION PLAN
4.1 Reclamation Plan Area
The property will be reclaimed according to the requirements set forth by Sawyer
County Land & Water Conservation personnel. Reclamation will occur after the
excavation activity is exhausted. A reclamation plan has been established as required
by Sawyer County Planning and Zoning for the acres disturbed by the excavation and
processing operations.
