Conditional Use Permit ti19-019;Donald&Marcella Thompson;Bumblebee Pit.
Part of the NEl/4 of the SWl/4 and Part of the NWl/4 of the SW1/4;all in SOl,T39N,ROSW;Parcel ri's
032-539-01-3101 and 32-01;75 Total Acres;Zoned Agricultural Two(A-2);Known as the Bumblebee Road
Pit. Permit is desired for the three(3)year renewal of conditional use permit#03-002 for the location of a
non-metallic mineral extraction operation,including rock crusher. The CUP was originally approved at
public hearing on April 15,2002 and renewed on April 15,2016.
Motion to approve the application by Paulsen with the NR135,plan of operation,reclamation plan,Hours
of 7am to 9pm,Monday-Saturday,Rock crusher and asphalt plat Hours of 6am to 7 pm,Monday—
Saturday,DNR Chapter 30,3 year renewal.Second by Bassett. All in favor.Motion carries.
Findings of Fact: It would not be damaging to the rights of others or property values.
Any person or persons jointly aggrieved by the decision of the Zoning Committee may appeal the decision
to the Sawyer County Board of Appeals to review the legality of the decision within 30 days after the date
of this notice.

Request: Three year renewal of conditional use permit 03-002 for non-metallic mineral
extraction operation including rock crusher and asphalt plant. Originally approved April 15,
2002. Last approved April 15, 2016 and would expire April 15, 2019. Since the application was
applied for prior to this date it will be held as a general renewal.
Project History & Summary of Request
The renewal of CUP 03-002 is for the location of a non-metallic mineral extraction
operation including rock crusher and asphalt plant periodically. The property is 75 acres and
zoned A-2. The existing use is a gravel pit and woodland area. Surrounding use is forestry and
light residential. Neazest residence is 2037'. Complaints have been received during renewal
process in the form of opinion letters but generally not during operation process.
The current hours of operations are 7 am — 9 pm Monday - Saturday. Gravel crusher and
asphalt plant are listed as periodically is in current plan. The Sawyer County Zoning &
Conservation Department recommends that hours for the gravel crusher and aspbalt plant should
be listed trom 6 am to 7 pm Monday—Saturday as a condition
Financial assurance has been received for $8000 and expires February 22, 2020 in the
form of an irrevocable letter of credit from Chippewa Valley Bank (attached)
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the applicaYion and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.

Don Thompson Excavaling will extract at most 20,000 cubic yards of (iil
material or slockpi(ed gravel per yard. Gravel crushing operations wi►I
process as much as 10,000 cubic years per year. This crushing operation
will typically occur during a two week period once per year to create a
gravel stockpile.
