electronia on the si[e be less than previously generated from previous equipment and strudures.2)All
lighting on all strudures be"down-lighting"excepting the anienna.3)Because construdion and dearing
practices are being done during the fall and winter,measures are needed to assure soil and ground
vegetation are to be protec[ed from erosion and sedimen[ation through use of sediment traps and o[her
standard mitiga[ions pradices.

infrastructure for our area.

appeal action to the Sawyer County Board of Appeals a[their expense to review the legality of the decision
within 30 days after the dote of this no[ice.

Purpose of Request:
Pennit desired for Communications Structure 1400 sq. ft. masonry building as per Sawyer
County Zoning Ordinance section 17.8(B)(10)
Project History/Summary of Request:
In 1992 a pennit was taking out for this initial "cominunication hub'' building. At that time, it
would appear that a CUP should have been required for this type of building by the Sawyer
County Zoning Office has no information pertaining to an initial CUP. Since no CUP had been
granted at that point a CUP approval process is now being requested to replace the existing
building there. In conversations with the agent, this building holds the "emergency broadcast
system relay" for the entire district. The Charter Communication team has noticed a disruption in
with the technology within the old building and equipinent needs to upgraded. Due to weather
and tiining restrictions an einergency approval was granted for a Land Use Permit from our
office with the stipulation that they will also need to be granted the after-the-fact CUP.
This request would then be for a communication hub/relay station under Section 17.8(B)(10).
Prior to granting einergency LUP approval conversations were held with the Town and adjacent
property owners asking what concerns they inay have. The main concerns were grading
activities, vegetation cover, and noise that the building would produce once constructed. In
conversations with the agent of this case the grading or driveway area would actually decrease in
steepness and no additional grading or vegetation removal would be required. Also, the noise of
the generators and other equipment associated with the building would actually decrease from
what is currently there. With this information, no other conditions have been identified as part of
this request except that communication noise is at or less than existing levels and that all other
applicable Town, County, State, and Federal Laws.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requireinents and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees to meets all of the requireinents and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use pennit. Any condition iinposed inust be related to the purpose of the ordinance
and be based on substantial evidence. The conditions inust be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions establislled by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the pennit must be supported by substantial evidence.

17.8 F•1: Forestry One District This district provides for the continuation of forest
programs and related uses in those areas best suited for such activities. It is intended
to encourage forest management programs and also to recognize the value of the forest
as a recreational resource by permitting as a conditional use certain recreational
activities which when adequately developed are not incompatible to the forest.
A) Permitted Uses
1) Production of forest crops, including tree plantations.
2) Harvesting of wild crops such as marsh hay, fems, moss, berries, tree fruits, and tree
seeds.
3) Multiple use trails, and wildlife refuges.
4)Signs subject to the provisions of Section 5.0.
5) Drainage where such activity will not be in conflict with the stated purposes of this
district.
7) Year round or seasonal dwellings permitted by a special use application subject to �
Section 6.9 or a Conditional Use per Section 18.5 and/or 18.6.
8)Licensed In-Home Day Care/Child Care(no more than 8 children)
B) Uses Authorized by Conditional Use
1)Public and private parks, playgrounds, and water sports areas.
2) Dams, plants for the production of electric power and flowage areas.
3)Trailer camps and campgrounds subject to the provisions of Section 6.6.
4) Forest connected industries such as sawmills, debarking operations, chipping
facilities, and similar operations.

1.Conditional Use Permit(CUP). '
Charter Communications(doing business as Charter Video Electronics,Inc.)have requested a
CUP from Sawyer County for a communications building structure on property zoned F-1
Forestry-One located in part of the NW'/<of the SE'/<of Section 30,T41 N,RSW,(14455 W
Chippewa Trail Road,Hayward WI). This requested use is a listed as authorized by CUP in
Sawyer County Zoning Ordinance for Forestry One.Three letters to adjoining landowners were
sent out.As of today only one letter was returned with a concern of site electronic noise.
Building in under construction to replace old"tin"building,roof is on,construction started in late
fall.Project was discussed and three concerns arose,two will be for CUP and one is needed
temporarily.Concems: �
1.Any sound and/or noise from the electronics on the site be less than previously generated
from previous equipment and structures.
2.All lighting on all structures be"downlighting"excepting the antennae.
3.Because construction and clearing practices are being done during the fall and winter,
measures are needed to assure soil and ground vegetation are to be protected from erosion and
sedimentation through use of sediment traps and other standard mitigations practices.
Motion was made by Joan Cervenka to recommend the Town Board recommend conditions 1 and �li
2,above,on the CUP and one issue,#3,as a temporary CUP clause.2"d by Mark Kerner,Motion

Jesse Suzan shared information to Planning Commission as to function and general use of and

C) Jesse Suzan for David Farley— Property is located in part of the NE '/4 of the NW Ya of Section
21, T 41N, R9W, Town of Hayward, Sawyer County, Wisconsin. Proposal is creation of two Out
Lots to be added to the parcels directly to the north of each Out Lot to resolve "gap" in ownership
records. Property owner discovered an adjacent narrow parcel of land and was informed that it
was showing as a "gap" strip based on a 1991 plat survey by Dan Peterson. Gap had been left
for some sort of assess to Golf course. Title search showed current ownership with Donnellan
Family.
With thought of due diligence, Cervenka contacted Hayward Civic Club, Steve Nichols, because
it appears that the ruff off of hole 2 is within the Out Lot narrow strip. Mr. Nichols had owned the
Farley property for a previous 40 years, and will make Golf Course aware of the ruff area. There
was a short discussion of adverse possession, which the Civic Club would need to assert.
Joan Cervenka motioned to recommend the Town Board accept the CSM as presented, 2^d by
Travis Hand. Motion carries unanimously.
3. Housekeeping:
A) Joan Cervenka distributed Oath of office and W4 forms to all present who may need them.
B) 2021 attendance was reviewed.
C) Brenda Dettloff's resignation was noted. There are two vacancies on the Committee.
D) Transportation Alternative Program Grant, (TAP) route and process was reviewed, due date
January 26, 2022. Travis offered to help.
E) Fun Days — Get ready for some fun! Presentation will be made for a January 23 Family Fun Day
at the Town of Hayward Recreation Forest: Sledding, skiing, Bonfire, Sleigh Rides, and more.
F) Room tax Ord. — Cervenka is working on updating Town's Room Tax Ordinance.
