Request: Pennit desired for the five (5) year renewal of CUP #18-018 for the location/operation of a non-inetallic mineral extraction, including rock crusher and asphalt plant This CUP was originally approved June 16, 1989 and most recently renewed October 19, 2018. Project History & Summary of Request: The renewal of CUP 18-018 is far the location of a non-metallic inineral extraction operation including rock crusher and asphalt plant. The property is approximately 154.44 acres with the current operation area of approximately 48 acres. Expansion will progress to the north. The current pennitted area totals 154.44 acres. The surrounding use is forestry, agricultural, and light residential. The nearest house is approximately 575' away from the current pit entrance across Hwy 77 with the nearest operation area of approximately 775'. Expansion would not be coming any closer to this nearby residence and all crushing and plant operations inust be a minimum of 1000' away. The Zoning Department has not received any complaint for this site but earlier this year there was a new pit proposed in this si�nilar area where a multitude of individuals came to the public hearing in objection. That new proposed pit was (2) 40 acre parcels away from this CUP renewal pit. Financial assurance has been received for $60,000 in the form of a bond. The noc-mal llours of operation are SAM-9PM, Monday-Saturday. Crushing hours (amended in 2018) are 7AM-7PM, Monday-Saturday with allowance to extend crushing hours to 9PM if special demand warrant. The asphalt plants hours are 6AM-9PM, Monday-Saturday with inaintenance allowed 1 hour before start up and 1 hour after shutdown. Typical operation is from March-November but if weather permits projects may come up Deceinber-February. Additional information for Conditional Use Permits: Substantial evidence means facts and information, other than merely personal preferences or speculation, directly pertaining to the requirements and conditions an applicant must meet to obtain a conditional use permit and that reasonable persons would accept in support of a conclusion. If an applicant agrees to meets all of the requireinents and conditions specified in the � county ordinance or those imposed by the county zoning board, the county shall grant the conditional use permit. Any condition iinposed must be related to the purpose of the ordinance and be based on substantial evidence. The conditions inust be reasonable and, to the extent practicable,measurable. The applicant must demonstrate that the application and all requirements and conditions established by the county relating to the conditional use are or shall be satisfied, both of which must be supported by substantial evidence. Days of the week — months of the year: Depending on the weather and upon local projects in the area, the Mrotek Pit will typically operate Monday through Saturday, March through November. However, if weather permits, projects may come up December through February. 7. Access Routes: a. Setback to lot lines: A 50' setback will be maintained between the operation and all lot lines. A 100' setback will be maintained between the operation and State Highway 77. c. Buffers: The site is buffered by existing trees on the property lines. An additional berm was erected and trees planted on the berm in 2017 to provide additional noise screening for the neighborhood to the east of the pit. d. Other: none 10. NR 216 Stormwater Permit: The Mrotek Pit has a WPDES General Permit with the Wisconsin Department of Natural Resources. The WDNR Facility ID Number is #25868. b. Surface and groundwater protection: The operation employs a variety of screening, crushing, and conveying equipment, including loaders and trucks. The lubrication, fueling, and repair practices used to maintain the equipment are designed to eliminate petroleum products from ground contact. Milestone Materials and Monarch Paving have an existing storm water plan for aggregate operations that employs Best Management Practices (BMP's) for pollution prevention. The management practices listed in the plan addresses both petroleum product handling and erosion control. The Storm Water Pollution Prevention Plan for the production activities addresses practices for proper storage, handling, and use of petroleum products, as well as inspection and response procedures. Any fuel for mobile equipment that may be stored on-site is stored in an aboveground tank with secondary containment. Plant foremen perform site inspections throughout the operating period. Observations and conditions are reported daily for all applicable environmental programs. 13. Erosion control measures a. Berms The berms are constructed of topsoil and subsoil and relocated as needed to the fringes of future areas to be mined and the property lines setbacks as the site is developed. The berms will be seeded with grass. When possible, the topsoil and subsoil stripped and removed will be placed directly into areas undergoing active reclamation. This procedure will reduce soil handling and help to preserve the soil viability for final reclamation and vegetation. b. Silt fences/Straw bale barriers During any phase of the operation where topsoil is being stripped or reclamation is being conducted, silt fences and straw bale barriers are used until seeding has been established. 14. Environmental Considerations a. Noise Noise is mitigated on the site by maintaining functional mufflers and exhaust systems on all internal combustion engines and by shielding mechanical processes with noise barriers. Noise to neighboring residences will also be mitigated by berms built around the operation areas. In 2017 an additional berm was installed between the operation and the existing treeline along State Highway 77 and trees planted on the berm to help assist with noise mitigation. 3 Mrotek Pit—CUP Renewal 8/23/2021 b. Dust Respirable dust exposure is minimized at the site by using wet suppression for processing aggregate materials and controlling fugitive emissions from peripheral activities, including trucking. Milestone Materials/Monarch Paving is committed to maintaining respirable dust limits within MSHA standards and to providing a healthy, dust-free environment for employees and neighboring property owners. c. Vibration—The operation does not involve any blasting. d. Impact on adjacent property owners We are committed to keeping our operation in a neat and orderly manner and to operate within our permitted hours of operation. Additional screening measure through berms and trees have been built along State Highway 77. Our asphalt plant has also undergone upgrades to help keep noise levels to the most minimal extent as possible. e. Litter/debris/contamination Solid wastes generated in the course of production will be disposed of in dumpsters provided by licensed haulers. Regular disposal intervals will be maintained to provide adequate availability. There is no hazardous waste produced in conjunction with the operation. Used oil and lubricants from equipment maintenance are collected for recycling by a licensed used-oil contractor. The waste receptacles are located away from active mining operations. f. Wildlife Wildlife is abundant at the property and the surrounding land owned by the Mrotek's and Sawyer County. g. Pipeline, utility, right—of—way safety None of the nonmetallic mine operation is conducted in any right—of—way. 15. What activities/projects will this mining operation support? a. Commercial sale of products The Mrotek serves the local State, County and Town projects as well as the commercial and private sale of products to the local community. 16.
