(F-1 ). Current operation is approximately 19 acres and is known as the Point Pit.
Request: Permit desired for the five (5) year renewal of CUP #18-018 for the location/operation
of a non-inetallic mineral extraction, including rock crusher. This CUP was originally approved
June 16, 1989 and most recently renewed October 19, 2018.
Project History & Summary of Request:
The renewal of CUP 18-020 is for the location of a non-metallic mineral extraction
operation including rock crusher. The property is approximately 56.46 acres with the current
operation area of approximately 19 acres. Expansion will progress to the north. The current
pennitted area totals 56.46 acres. The surrounding use is forestry, commercial, and light
residential. The nearest house is approximately 700' away from the current pit entrance operation
area of approximately 1200'. Expansion would not be coming any closer to this nearby residence
and all crushing and plant operations must be a ininimutn of 1000' away.
The Zoning Department has not received any recent or new complaint for this site.
Financial assurance has been received for $33,000 in the forin of a bond.
The normal hours of operation are 7AM-7PM, Monday-Friday. Crushing hours are the
same for 45 days per year. Typical operation is froin March-November but if weather permits
projects may come up December-February.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant inust meet to
obtain a conditional use pennit and tllat reasonable persons would accept in support of a
conclusion. If au applicant agrees to �neets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use pennit. Any condition imposed inust be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent �
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by tlle county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the pennit must be supported by substantial evidence.

e. Other: Crushing is allowed for 45 days per year.
6. Days of the week — months of the year: Depending on the weather and upon
local projects in the area, the Point Pit will typically operate Monday through
Friday, March through November. However, if weather permits, projects may
come up December through February. Our current Conditional Use Permit allows
for crushing at the Point Pit to occur for 45 days per year.
7. Access Routes:
a. Roadways to be used: Traffic enters and exits the site from an existing
driveway State Highway 77.
b. Driveway Permit: The Point Pit has an existing driveway located at Fire
Number 10382W.
8. Major Equipment to be used During the Operation:

c. Screening plant: yes
d. Washing equipment: yes

f. Location — nearest principal structure, residences within 1000'
There are no residences within 1000' feet of the crusher.

9. Excavation
a. Depth: approximately 30 feet
b. Setback to lot lines: A 100' setback will be maintained between the operation
and all property lines, with the exception of the adjacent west property line,
which has an active gravel pit. Mining will be conducted to the west property
line to allow for a smoother transition in to reclamation of that area. A 100'
setback will be maintained between the operation and State Highway 77.
Topsoil and overburden will be stored within the setback areas as berms. A
100' setback will be maintained between the excavation and the wetland
located in the northwest corner of the property.
c. Buffers: The site is buffered by existing trees on the property lines.
d. Other: none
10. Lot lines—have they been surveyed, flagged and easily identified?
a. Fencing: The property has been surveyed.
b. Identification and safety signs: There is an identification sign at the Point Pit
entrance.
11. Navigable water within 500', non- navigable wetlands: No navigable water
exists within 500' of the operation. A wetland exists in the northwest corner of
the property. The operation will maintain a 100' setback from the wetland.
12. DNR erosion control or water quality permits
a. NR 216 Stormwater Permit: The Point Pit has a WPDES General Permit
with the Wisconsin Department of Natural Resources. The WDNR Facility
ID Number is#25869.
b. Surface and groundwater protection: The operation employs a variety of
screening, crushing, and conveying equipment, including loaders and trucks.
The lubrication, fueling, and repair practices used to maintain the equipment
are designed to eliminate petroleum products from ground contact.
Milestone Materials has an existing storm water plan for aggregate operations
that employs Best Management Practices (BMP's) for pollution prevention.
The management practices listed in the plan addresses both petroleum product
handling and erosion control, including the on-property containment of storm
water runoff.
The Storm Water Pollution Prevention Plan addresses practices for proper
storage, handling, and use of petroleum products, as well as inspection and
response procedures. Any fuel for mobile equipment that may be stored on-
site is stored in an aboveground tank with secondary containment. Plant
faremen perform site inspections throughout the operating period.

Observations and conditions are reported daily for all applicable
environmental programs.
13. Erosion control measures
a. Berms
Berms are constructed of topsoil and subsoil and relocated as needed to the
fringes of future areas to be mined as the site is developed. The berms will be
seeded with grass. When possible,the topsoil and subsoil stripped and removed
will be placed directly into areas undergoing active reclamation. This procedure
will reduce soi] handling and help to preserve the soil viability for final
reclamation and vegetation.
b. Silt fences/Straw bale barriers
During any phase of the operation where topsoil is being stripped or reclamation
is being conducted,silt fences and straw bale bamers are used until seeding has
been established.
14. Environmental Considerations
a. Noise
Noise is mitigated on the site by maintaining functional mufflers and exhaust
systems on all internal combustion engines and by shielding mechanical processes
with noise barriers. Noise to neighboring residences will also be mitigated by
berms built around the operation areas within the property line setbacks.
b. Dust
Respirable dust exposure is minimized at the site by using wet suppression for
processing aggregate materials and controlling fugitive emissions from peripheral
acrivities, including trucking. Milestone Materials is committed to maintaining
respirable dust limits within MSHA standards and to providing a healthy, dust-
free environment for employees and neighboring property owners.
c. Vibration—The operation does not involve any blasting.
d. Impact on adjacent property owners
We are committed to keeping our operation in a neat and orderly manner and
to operate within our permitted hours of operation. Additional screening
measures through berms and trees will continue to be built in the 100'setback
area along property lines where needed.
e. Litter/debris/contamination
Solid wastes generated in the course of production will be disposed of in
dumpsters provided by licensed haulers. Regular disposal intervals will be
maintained to provide adequate availability. There will be no hazardous waste
produced in conjunction with the mining operation. Used oil and lubricants
from equipment maintenance will be collected for recycling by a licensed
used-oil contractor. The waste receptacles will be located away from active
mining operations.

f. Wildlife
Wildlife is abundant at the property and the surrounding land.
g. Pipeline, utility, right — of— way safety
None of the nonmetallic mine operation is conducted in any right — of— way.
15. What activities/projects will this mining operation support?

The Point Pit serves the local State, County and Town, commercial and private
projects as well as the commercial sale of products to the local community.
16. Reclamation Plan
In accordance with NR 135, the Point Pit has an approved Reclamation Plan on
file with Sawyer County Land and Water Conservation Department.
18. Bonding or Financial Assurance
Milestone Materials currently has a reclamation bond on file for the Point Pit for
$33,000 to cover the $1500/acre financial assurance requirement.

Section 5—Recommend all operations be restricted to Monday through Friday, 7:00 a.m. to 7:00 p.m. with an allowance
for maintenance 1 hour pre and 1 hour post operations. This would be consistent with Conditional Use Application #21-
028.
The "Special Demands Warrant" needs to be clarified. Recommend that applicant be required to request Special
Demand Warrant in writing to the County or the Town prior to commencing operations outside of the permitted hours
of operation. (This to be used for emergency repairs only).

Section 6 is titled Days of the Week, but the text deals with months. Note there is no real restriction here; operations
are permitted all 12 months of the year because "if weather permits" is sufficiently vague to allow operations in nearly
all weather conditions. If there is a monthly restriction it should be stated.
45 day limit needs to be defined. Is any operation for any duration counted as a day;or is 8 hours a day; or is_10 hours a
day? Who is monitoring the number of days used? Recommend the applicant submit a report to the County or the
Town monthly detailing the number of days used during the month where a day is counted for any day the crusher is in
operation for more than 1 hour.
Any variation to the approved months or the 45 day restriction should be requested by the applicant in writing and
approved by Sawyer County Zoning or the Town before commencing operations outside the approve hours of operation.
