The impervious surface standards as indicated in State Statutes would allow for a maximum of 15% iinpervious surfaces based on your property land area without doing additional mitigation to go to a higher percentage. Impervious surfaces means, "an area that releases as runoff all or a majority of the precipitation that falls on it. "Impervious surface" excludes frozen soil but includes rooftops, sidewalks, driveways, parking lots, and streets unless specifically designed, constructed, and maintained to be pervious. When the new blacktop was installed a Land Use Permit would have been required from our office for"paving' of these areas. As part of this Land Use Permit you would have also needed to indicate the proposed impervious surface amounts of the property. I am setting an order for correction for December l, 2022 to complete the attached Land Use Pennit with a $75 fee as well as thoroughly complete the impervious surface worksheet portion of the attaclled Land Use Pennit. Additional drawings may be required as to detennine the exact amount of blacktop that was added to the property. Failure to comply with this order for correction will result in citations. I have also attached the Shoreline Mitigation Agreement which may be needed if you are in excess of 15% iinpervious surfaces based of your land area of 0.853 acres. You also have the option of doing treated impervious surfaces but that will require an engineered design plan. Please contact me if you have any addition questions.
