Request: Add additional 37 campsites to an existing campground already containing 34
campsites. Total of 71 campsites including existing 8 rental cabins and existing Lodge/Entry
Project History:
See staff report from Rezone 21 -005 for additional project history. The existing
campground consisting of 34 seasonal sites and 8 rental dwelling units plus lodge would be
considered existing non-confonning; in that it was in operation prior to zoning ordinance
changes that would only allow for this type of operation with the RR-2 zone district.
Previously the owners/applicants had a request for a total of a 150 unit campground
including land across Hwy CC. Ultimately that request was denied at the 'Town level and
withdrawn prior to Zoning Committee. Since the previous CUP had no action taken upon it and
was withdrawn by the applicant they would be able to reapply without having to wait 1 year
before filing a new CUP as described in Section 8.0 of the Sawyer County Zoning Committee
By-Laws.
Summary of Request:
The proposed 37 sites would be located in 2 separate areas as shown by the attached map
delivered to our office by the applicant. The sites would be designated by a typical 36' x 60' site
area including a 15' x 43' gravel pad, 18' x 18' gravel parking area, and a potential small shed
area. Soine of these sites will most likely be utilized by park model units but all will be
independent sites with their own sewer, water and electric hook-up. With the proposed map

We recently received notice from the Department of Natural Resources that they are not pursuing any
additional violations as far as the restrictive covenants are concerned, with recent rehab and structure
removal work that is now in compliance. All of the covenants wil/have to be adhered to if[he
development moves forward.
Please see the a[tached approval letter from CUP#20-013 that was approved with conditions on May
21, 2021 these conditions will hove to met moving forward. With the compliance with DNR covenants
you may proceed with the approved CUP#20-013.

Hello,
I have followed up on the northern parcels, under Sisko's ownership,that had mowing concerns inside of covenant
lands. I was able to work with my collaboration team (real estate and legal) on this and we were able to find a leaf-off
layer map from May of 1992. This property was being cared for then as it is today.The covenants took hold in 1989
officially so it has been determined that the land use was either the same or can't be determined that the use did or did
not pre-date the covenants.
This being said the DNR will not be pursuing any additional violations as far as the restrictive covenants are concerned.
The Sisko's property, with the recent rehab and structure removal work is now in compliance. All of the covenants will
have to be adhered to if the development moves forward. That letter was already issued by the department in March. If

That particular piece of property was not surveyed by me yet. I have not sent an official response to the permit applied
for on the additional sites as that was being treated separately, at least that was my intention.
I was also under the impression that the Town would not move forward with the development project until the other
side of the property is compliant? That side of the property will of course have to adhere to all the same covenants as

Dear Pinewood Properties, LLC:
On 10/12/2021 I visited Sisko's Pine Point Resort to assess the corrective actions taken in response to a violation
letter issued by the Wisconsin Department of Natural Resources on 6/23/2021 . The cited violations of the
Chippewa Flowage covenant restrictions, recorded in the Sawyer County Register of Deeds office in Volume 429
Deeds, pages 203-207, were outlined in the violation letter, and included vegetation clearing/ground disturbance
and prohibited structures.
Upon completion of the visit and documenting the restorative work performed (Figure 1 & Figure 2) it has been
determined that the violations have been corrected as outlined and agreed upon in the 6/23/2021 letter. Given the
identified violations were corrected and removed as requested, there will be no further enforcement action taken
by the Department at this time.
As the photos below show, the ground where structures had been placed has been restored to a natural grade and it
appears that native vegetation will be allowed to repopulate the area. Please note that the covenant restrictions
require that sufficient native tree seedlings be maintained or native tree species be planted in the area between ]00
and 125' from the water in order to maintain a wooded canopy in this area.

Subject: Notice of Chippewa Flowage Covenant Violations
Dear Pinewood Properties, LLC:
Wisconsin Department of Natural Resources(WDNR)and Town of Hunter staff visited your property at 8677N
County Rd CC in the Town of Hunter, Sawyer County, Wisconsin (the Property)on April 30, 2021 in response to
observed clearing/grading and placement of structures on the Property. The Property is encumbered by 100-foot
and 1000-foot buffer zone covenant restrictions(hereinafter Covenant)recorded in the Sawyer County Register of
Deeds office in Volume 429 Deeds, Pages 203-207, and attached to this letter for your reference. During the visit,
WDNR identified violations of the Covenant and determined that additional inspection was necessary. A follow
up visit occurred on June 21, 2021, after the 100-foot buffer zone was professionally surveyed and marked. The
following violations were identified and confirmed during that visit.
Vegetation Clearing and Ground Disturbance
The vegetation clearing and ground disturbance that has occurred on the southeastern portion of the Property is in
excess of the allotted 30-foot-wide access corridor described in the Covenant, which provides:
Filling,grading,placernent of structures and cutting native vegetr�tion withirr the buffer zone is
prohibited. . . with an exception allowing that "Native shrubbery and dead and dying trees r�aay
be cut and ground vegetation nzay be rnowed to provide a water access corridor. Access corridors
shall not exceed 30 feet in width for any 100 feet of shoreline. Suffzcient native tree seedlings
shall be n7aintained, or native tree species planted in the access corridor to maintain a wooded
canopy.
Covenant, p. 205 (emphasis added). The DNR documented this work being done inside of the 100-foot buffer
zone with covenant restrictions and found that this grading/clearing was in excess of the allotted 30 feet for any
100 feet of shoreline. The filling and grading primarily occurred underneath the structures placed on sites
8,9,10,1 1. There was gravel added under these structures as well.
Prohibited Structures
The Covenant requires that all structures within 1000 feet of the shore must be natural wood or painted earth
tones, and it provides that they cannot exceed 35 feet in height. The Covenant allows existing structures located
within the 100-foot buffer to remain unless they are moved, repainted or replaced—events that trigger the
compliance with the Covenant. The Covenant further provides:

with exceptions that allow for certain piers and signage. Covenant, p. 205 (emphasis added).
Structures that post-date the Covenant were observed on the Properiy within the 100-foot buffer zone restrictions
on April 30 and new structures were also observed on June 21, in violation of the Covenant. Ail of the structures
within the 100-foot buffer zone must be removed or moved and the ground beneath and around them must be
restored accordingly.
This letter serves as your formal written Notice of Violation of the aforementioned Covenant restrictions. The
Covenant provides that if violations are not removed or corrected within 90 days after receipt of this Notice, title
to the property will revert to and revest in the grantor. By this letter and based on your assurance that all
filling/grading/clearing and construction in the buffer area will immediately cease,the DNR agrees that you have
until 10/15/2021 to correct the violations identified here. More specifically, it is our understanding that you agree
to the following terms and deadlines:
You shall:
• Immediately discontinue all clearing and grading activities inside the 100-foot buffer zone.
• By 10/15/2021, plant native tree and shrub species in the cleared areas inside the 100-foot buffer zone,
restore to a natural appearance and remove all gravel that has been added to the buffer zone.

zoning on the subject property from RR-1 to RR-2: and to seek a eonditional use perrnit

revi��d praposal.
My cliEnts' property is in the immediate vicinity ofthe subject property and this land has
been in the Uihlein family for generations. The increasad#ra�c, density, noise and light
polluxion of this trailer park would severely impact my clients' enjoyment of his property.
I knaw his naighbors s#ill strongly feel the same.
The r.ombined;requests would represent a monumental change ta the use, character
- a�tl quiefi nature of the Chippewa F[owage�rea. SmaQ mom-and-pop resorts have long
been a part of the lacal landscape, but this proposed large-scale eomme�cial
development would be ta�ally oufi of character far#he area. If allowed; it would
completely,destroy#he bucolic nature of th� Chippewa Flowage.
The 5ize of the requested campgraund expansion is completely disproportionate to the
la�ad �r�a and would.leave very littl� green spac�remaining. The�e will hardly be any
"woods" left on this patch of the Northwoads. Th�y propose to increase fihe number of
existing campsites from 34 to a totai of 71. This wauld more than tfauble the number of
campsites.currently located on th� property. We afso understand fihat the r�sart
installed 't0 addi#ional c�mpsites last year withou#g�ing through the proper permitting
proc�ss. ,
The�xisting zoning of RR-1 for tl�e subject property should not be changed and any�
requ�st for a conditional use pe'rmit for such a substantial comrn�ercial developmen� like

This application was first submitted on a much larger scale and then withdrawn after the
Comprehensive Plan Meeting.It was resubmitted with what v�e felt was a more amenable
plan far the property.It has been a resort for many yeazs and it is to be expected that the
Owners would like to;row their business.That being said,concern for the resource is an
important part of ttle decisien making process.The WDNR has become involved because
of covenants placed on the property.There are regulatory agencles that wili be involved
in this expansion,and we aze placing our trust in those agencies to make sure it is done
