The NE '/ or the NE '/, Part Government Lot 1, Part Government Lot 2, Lot 4 CSM 34/220 #8161 ; SA33, T41N, R07W; Parcel #024-741 -33-1103; Property Zoned Forestry One (F-1) and Residential/Recreational Two (RR-2.) Request: The request is for Island Development subject to Section 4.4 (2) of the Sawyer County Shoreland-Wetland Protection Ordinance. The proposed structure(s) are to be an approximately 24' x 36' cabin with small loft area, porch, and smaller shed/accessory structure. The final plans for the building(s) have not been approved yet but this would still require a Land Use Permit from Sawyer County Zoning if a CUP is granted. Project History & Summary of Request As per Section 4.4 of the Sawyer County Zoning Shoreland-Wetland Protection Ordinance this type of island development request requires the prior granting of a CUP. The applicant has met all of the other conditions as specified for island development including a vacant main land access point, plans for a non-plumbing sanitation device, meeting all other applicable setback requirements. In conversations with the applicant it was discovered that there is also a bald eagle nest tree also on the island. In due-diligence by the applicant they have also been granted a U.S. Fish and Wildlife Service "Short-Term Eagle Incidental Take Permit". The Sawyer County Zoning Department has a copy of this permit but it is up to the owner and the U.S. Fish & Wildlife Service to abide by the conditions as set forth in said permit. Additional information for Conditional Use Permits: Substantial evidence means facts and information, other than merely personal preferences or speculation, directly pertaining to the requirements and conditions an applicant must meet to obtain a conditional use permit and that reasonable persons would accept in support of a conclusion. If an applicant agrees to ineets all of the requirements and conditions specified in the county ordinance or those imposed by the county zoning board, the county shall grant the conditional use permit. Any condition imposed must be related to the purpose of the ordinance and be based on substantial evidence. The conditions must be reasonable and, to the extent practicable, measurable. The applicant must demonstrate that the application and all requirements and conditions established by the county relating to the conditional use are or shall be satisfied, both of which must be supported by substantial evidence. The county's decision to approve or deny the permit must be supported by substantial evidence. Our Bald Eagle guidelines indicate a maintained 660-foot buffer if the bald eagle nest can be seen from where human activities will take place or a 330-foot buffer if the activity can't be viewed by the eagles. After issuing bald eagle disturbance permits for 11 years,our office has determined that bald eagles in our jurisdiction are much more tolerant than once thought.Also,nationally we are working on reducing the buffer distance guidelines. You indicated you could possibly keep a distance of 100 feet from the bald eagle nest,and we recommend a disturbance permit be issued to protect you and the eagles.
