Request: Permit desired for an Accessory building 16' x 30' in size across a Town road from the
primary dwelling located at 7884N Highland Ave. Building would be used for personal boat
storage and would be less than 12' in height. Sawyer County Ordinance section 4.26 (2) The
construction of a single accessory structure on an adjacent parcel divided by a Public Koadway
that does not contain the principal structure may be allowed under this subsection by conditional
Use.
Project History & Summary of Request
The applicant is requesting to build a 16' x 30' accessory structure on a vacant parcel across the
Town Road per Section 4.26(2) of the Sawyer County Zoning Ordinance. Sawyer County Zoning
determines that the proposed accessory structure cannot be constructed on that part of the lot
containing the principal structure due to the inability to meet setbacks primarily due to the location
of the existing drainfield for the residence and other outbuildings (see attached maps included in
packet). The proposed accessory structure would meet all other required setbacks on vacant parcel
and vacant parcel already has a fire number associated with it.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees �o meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.

(Section 8.10) because:
1) It would not be damaging to the rights of others or property values because there are no neighbors.
�) [t would not create vaffic or highway access problems. A driveway permit was approved.
3) [t would be compatible w ith the surrounding uses and the azea which is residential.
