Euclid Ave. Oak Park, IL 60302 RE: Parcel :6.7, S 28, T 40N, R 08 W, Town of Bass Lake: Issue of Land Use Permit and Property Inspection Dear Mr. Weicher: Last week I was reviewing an Application for Land Use Permit submitted by you for the construction of additions onto your cabin and renovation of the foundation of the cabin. It was apparent from reviewing the application that the cabin is nonconforming as it is located closer than 75' to Lac Courte Oreilles. At that point I decided to visit the property and to perform a property inspection. A copy of the inspection report is attached. During my inspection I determined that the average lake setback far the cabin is 45' from the lake. This setback is significant, as any construction activities closer than 45' to the lake would require the prior approval of a variance by the Sawyer County Board of Appeals. Fortunately the cabin is located 50'/53' from the lake. All proposed improvements are further than 45' from the lake. The 50% current estimated fair market (CEFMV) rule applies in this situation, as the cabin is a nonconforming structure. The "50% rule" restricts the cost of improvements to a nonconforming structure to no more than 50% of the CEFMV of the structnre. Construction activities exceeding 50% CEFMV must be approved by the Sawyer County Board of Appeals. The application that you submitted indicates construction costs of "$90-105,000." The costs related to the 50% CEFMV are the costs of materials and labor to enclose an addition, to include the foundation, and to finish the interior of the addition(i.e., sheet rock). Costs related to plumbing, heating electrical, window and floor coverings etc.; are not related to the 50% CEFMV. The procedure to determine the 50% CEFMV of a structure is to obtain the assessed value of the structure from the County's Real Estate Assessment and Taxation Rolls and then to convert this value to current estimated fair market value. However, due a division of property, the assessed value for this cabin is not presently available to the County. However, the assessed value of this cabin may be available from the Town of Bass Lake assessor. I shall write a letter to the assessor requesting the assessed value of this cabin. ' Additionally, this office has no information (i.e, soil test or sanitary permit on file) for the septic system servicing this cabin. In this situation (no records on file) a land use permit cannot be issued until the septic system has been inspected to determine if it is of adequate size to support the cabin and if the system is functioning properly. A part of the inspection is to do at least one soil boring adjacent to the drainfield. A Wisconsin licensed soil tester must perform the soil boring. I have enclosed a list of licensed soil testers who work in this county. While doing the side lot line setbacks I determined that the cabin setback to the north lot line (a ribboned stake) was approximately 40'. The cabin setbacks to the south lot line varied from 32' —23'. The required minimum side lot line setbacks are no closer than 10' to on side lot line and no closer than 30' to the opposite side lot line. The south lot line would be determined to be the 10' lot line as the setbacks from this lot line to the existing cabin is already less than 30'. This brings up the issue of the 15' addition on the north side of the cabin. If the north lot line setback to the existing cabin is indeed 40' then only a 10' addition may be constructed on the north side of the eabin in order to maintain the minimum 30' side lot line setback. The Sawyer County Board of Appeals must approve a variance to construct an addition closer than 30' to this lot line. In summary, this office can take no action on the application until the assessed value is determined for this cabin, the condition/sizing of the septic system has been determined and side lot line setbacks aze met.
