Violation of the Sawyer County Zoning Ordinance —Construction of a Storage Building
Closer than 40' to a Nonnavigable Wetland
Dear Mr. Syslo:
The purpose of this letter is to respond to your concerns about wetland setbacks and to
explain the "afrer-the-fact" variance process.
On March 1, 2001 this office issued a Land Use Permit for the construction of a 42'x53'
storage building on your property. The application did not indicate any wetlands within
40' of the proposed building site. It was later determined by this office (Friday, June 29,
2001) that the storage building had been constructed as close as 24' to a nonnavigable
wetland. A representative of the Department of Natural Resources verified the wetland
boundary on Wednesday, July 25, 2001.
The construction of this storage building within 40' of the adjacent wetland is a violation
of Section 4.49, Sav✓yer County Zoning Ordinance. I tmderlined that part of the paragraph
that pertains to your situation. The citation fee for this violation is $33�.00. A citation
shall be issued for this violation.
4.49 SETBACKS FROM NAVIGABLE WATER
1) For lots that abut on navieable waters, all buildings and structures, new dwellin�s on vacant lots and
replacement dwellin�s; except piers, boats hoists, boathouses, and open fences which may require a lesser
setback, shall be set back a minim�m of 75 feet from the ordinary highwater mark of navi�able waters and
wetla�ds adjacent to any navieable water. All setback distances are measured from the overhang or
appendage such as a deck, horizontally to the closest point of the ordinary highwater mark For lots [hat
abu[on nonnavioable wetlands. all buildin�s and struc[ures shall be set back a minimum of 40 feet from the
wetland boundary. Navigable wetlands shall be de[ermi�ed by the zoning administraror.
You also wanted information pertaining to "after-the-facP' variances. The procedures
pertaining to "after-the-fact" variances are the same as for any variance:
• The property owner submits an application for variance with a $2�0.00 fee.
• Adjacent property owners within 500' of the applicanYs property are notified
by letter of the variance application.
• Notice of the application for variance is published in the local newspapers,
• The respective Town (Town of Round Lake) holds a meeting and makes a
recommendation to the Sawyer County Board of Appeals and
• The Sawyer County Board of Appeals holds a public hearing and makes a
decision on the application.
While the procedure remains the same, the primary difference between an "afrer-the-facP'
variance and a"regular" variance is that the property owner applying for an"after-the-
fact" variance has already taken an action (i.e., construcYed a storage building closer than
40' to a wetland area) that required the prior granting of a variance by the Sawyer County
Board of Appeals. And, for whatever reason, the property failed to obtain approval of a
variance prior to taking that action.
Mr. Syslo there are three options available for the storage building.
1. Remove it entirely,
2. relocate it so that all required minimum setbacks are met, or
3. apply for an "afrer-the-facY' variance hoping that the Sawyer County Board of
Appeals will allow the building to remain in its present location.
Mr. Syslq I have enclosed the following documents with this letter:
• Inspection Report for the above building,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance - Additional Information." and a completed
• "Variance Application."
Please review the inspecYion report, read the summary on court decisions and complete
the request for additional information.
If you believe that you meet the criteria for the requested variance, you should then
review the variance application for correctness, sign it, and retum it to this office with a
check in the amount of$250.00 made to the "Sawyer County Zoning Administration" by
Friday, September 7, 2001 for hearings in October 2001.
The "Application for Variance - Additional Information" must also be filled out and
retumed with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
retum both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your application will be reviewed at two public hearings. The first hearing will held by
the Town of Round Lake at 6:30 P.M., Thursday, October 11, 200L You should contact
Kathy McCoy, Clerk, Town of Round Lake at(715) 462-3723 to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, October 16, 2001 in the large courtroom located in the Sav✓yer County
Courthouse. You or your representative should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Round Lake is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance(s) that you
have requested. Therefore, you sbould consider using any means at your disposal (i.e,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
If the application with supporting documents is not retumed to this office by Friday,
September 7, 2001, then, by November 1, 2001, the storage building must either be
removed or relocated so that all minimum setback requirements are met.
