Taheny 6159 SO Kostner Ave. Chicago, IL 60629-5219 RE: Unit #6, Black Mallard Condominium, Paroel—35.6, S O5, T 38N, R 09W: Property Inspection Dear Mr. Taheny: Enclosed is a copy of the inspection based on my visit to your property on Monday, September 17,200 L The purpose of my visit was to determine options available to you for the expansion of your cabin. The average lake setback was determined to be 66' from the ordinary high-waCer mazk (OHWM) of the lake. Flags were set on each side of the cabin at this distance from the OHWM. The significance of this setback is that constniction activities closer than 66' to the OHWM would require the prior approval of a variance by the Sawyer County Board of Appeals. The cabin is a nonconforming structure in that it is closer than 75' to the OHWM, closer than 20' to Unit#5 and it does not have a minimum dwelling width of 20 feet. The Sawyer County Zoning Ordinance requires a minimum setback distance of 20' between condominium units and a minimum dwelling width of 20 feet. Additionally, the cabin is substandard in size (area) as the minimum habitable enclosed area for a one bedroom dwelling in this zone district (Residential/Recreational One) would be 500 square feet. The cabin has an area of 432 square feet. Because of the nonconformity's, the 50% cunent estimated fair market (CEFMV) rule would apply to the expansion of the cabin. The"50% rule" restricts the cost of improvements to a nonconforming structure to no mare than 50% of the CEFMV of the structure. The 50% CEFMV for the cabin is $6,500. Construction costs exceeding $6,500 would require the prior approval of a variance by the Sawyer County Board of Appeais. The costs related to the 50% CEFMV are tUe costs of materials and labor to enclose an addition and to finish the interior of the addition (i.e., sheet rock or paneling). Costs related to plumbing, heating electrical, window and floor coverings etc.; are not related to the 50% CEFMV. Roof or foundation replacement costs would be a part oFthe 50% CEFMV. Ordinary repair and maintenance activities are allowable for nonconfonning structures and are not related to the 50% CEFMV. Examples of ordinary repair and maintenance activities are paintingistaining, replacing siding roof shingles and exterior windows and doors.
