Dear Mr. Stinson:
I have enclosed the following documents with this letter:
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance - Additional Information," and a completed
• "Variance Application."
Please review the inspection report, read the summary on court decisions and complete
the request for additional information.
If you believe that you meet the criteria for the requested variance, you should then
review the variance application for correctness, sign it, and return it to this office with a
check for $250.00 by Friday, July 6, 2001 for hearings in August 2001 .
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents ar failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your application will be reviewed at two public hearings. The first hearing will held by
the Town of Lenroot at 7:00 P.M., Monday, August 13, 2001 . You should contact Lois
Miller, Town of Lenroot Clerk, at (715) 634-5902 (home) to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, August 21 , 2001, in the large courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Lenroot is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
During my visit to your property we discussed that Fishing Has No Boundaries obtained
approval of a variance (98-002). The major differences between these two situations are:
(1) Fishing Has No Boundaries owns the property for which the variance was
applied for—the property is not owned by a private individual and
(2) the application pertained to a"storage building to store equipment used at the
Fishing Has No Boundaries event for anglers with disabilities"—a use that
was justifiable to the Board.
I believe a major problem maybe convincing the Board that the real purpose of your
request is not to have a screened building for your personal use. The issue is complicated
by the fact that you applied for a Land Use Permit to construct a 12'x16' "gazebo" on this
property, and it appears that it was only after it was determined that the gazebo could not
be constructed that its use by other persons/organizations was considered.
I believe you should be prepared to present to the Board a plot plan showing toilet and
washing facilities,parking area(s) and any other facilities that would be required far use
of this property by disabled persons/organizations. The Board will probably be of the
opinion that if this property will be used by groups, then more facilities than just a
screened building will be required.
