Yesterday I visited the Schultz property to discuss the fish house. The fish house is a
nonconforrning structure—it is only 17' from the lake and it encroaches onto an adjacent
(Linehan) property. The Schultz's have made some changes to the fish house that may
have exceeded its 50% current estimated fair market value.
Could you provide me with the assessed value of the fish house only.

Dear Mr. Schultz:
Yesterday, I inspected the fish house at the request of the Linehan's. The concern is the
improvemen;s that aze being made to this structure.
The fish hou>e is a nonconforming structure in that it is closer than 75' to the lake and it
also encroacl�es onto the Linehan's property. As a nonconforming structure, there are a
number of issues that must be addressed when contemplating improvements to that
structure.
First, you are permitted to perform ordinary repair and maintenance on the fish house.
Ordinary repair and maintenance consists of repainting, replacing windows and doors (not
adding windows and doors), replacing roof shingles etc. Ordinary repair and maintenance
does not include structural changes that would extend the life of the fish house (i.e., new
walls, roof, foundation etc.). Ordinary repair and maintenance activities do not require a
permit from this office.
A second concern is the "50% current estimated fair market value (50%CEFMV) rule.
The "50% rule" restricts the cost of improvements to a nonconforming structure (the fish
house) to no more than 50% of the CEFMV of that structure. The 50% CEFMV is
calculated from the assessed value of the structure. I shall be contacting the Town of
Edgewater assessor for the assessed value of the fish house. The "50%rule" does not
include the costs related to ordinary repair and maintenance.
Another concern is the change in use of a nonconforming structure. The fish house must
remain a fish house; it cannot be converted to any other use (i.e., a bunkhouse etc.).
From my observations, it appeazs that:
1. 't'ou are performing more than ordinary reoair and maintenance on the fish
house.
2. '�'ou may be changing the use of the fish house to something other than a fish
house and
3. '�'ou may have already exceeded the 50% CEFMV of the fish house.
Mr. Schultz, I would suggest that you cease all activities related to the fish house until I
receive the assessed value information form the Town assessor.
