RE: "Cease and Desist Order"to stop pumping raw sewage into the wetland and
pumping wash water onto the ground. "Order for Correction"install/replace existing
failing sewer system before July 1,2001.
Dear Mr.Rosenow:
I responded to a sewer violation on your property yesterday. Disposing of wash water
and sewage onto the ground is illegaL You are in violation of the following: 11.18 5.)
Improper disposal of domestic waste$458.00.
I will not issue a citation if I receive you full cooperation and abide by the stated
deadlines and following conditions:
1.) Stop pumping wash water onto the ground
2.) Stop pumping raw sewage into wetland
3.) Contact old plumber/soil tester to dig soil pit by the existing system to verity soils for
code-compliance.
4.) If your septic/sewer system and soils are not code-compliance,install code-
compliant septic/sewer on or before July 1,2001
5.) In the mean time,if sewage ponding or backup occurs,contact licensed pumper to
pump and remove sewage on"as needed"basis.
We have contacted Wisconsin DNR to conduct an on-site inspection to discuss the repair
or correction to the ditching you have done in the"wetland"azea. You have dug a ditch
to release the raw sewage and wetland flow. Unfortunately,due to snow melt and heavy
rains the raw sewage and soapy water has flowed to the ditch line,down the road and
across the road onto your neighbors property to the West. We smelled sewage odors and
witness soapsuds in the ditch line.
Your actions aze totally illegal,unhealthy and unsanitary. Do you realize that placing
raw sewage on the ground may affect the quality(safety)of your well water,as well as
your neighbors well down slope to the West?
I am asking for your cooperation on these matters and that you address these matters in a
timely manner. Should I discover or prove for further the violations of this order, an
immediate citation will be issued.

Dear Mr. Jennings,
This letter is in response to your letter dated October 3, 2001. Pm sorry for the delay of this letter
but I have been doing a lot of field inspections for the last rivo months and find it nearly
impossible to complete my office paperwork.
Enclosed please find copies of all correspondence involving Mr. Rosenow, inspection report,
new soil test #O1-268 and a copy of Comm 81.01(92) regarding failing system.
My first contact with Mr. Rosenow was on April 23, 2001. Since my first contact Mr. Rosenow
has been very cooperative and has complied with all my requests.
I have had doubts of why his septic/sewer system is ponding. On August 30, 2001, soil tester
Ron Spreckels Jr., Carl Lippert, Wastewater Specialist WI Dept. of Commerce, and I met on-site
to look at soils and another suitable replacement sewer site. We found suitable soils by the
existing system and in the replacement site.
Mr. Rosenow has had ponding water of 8"-10", spiked to some 20" and now has dried up to 0".
It appears that the hi�h levels may be attributed to heavy rainfalls, and previous heavy laundry
usage.
I initially felt, with an unusual high spike of 21" in the vent cap, that he experienced failure and
slow drainage in his household. However, now that the water in the vent has receded it is a bit
mysterious. This may be attributed to not much rainfall afrer summer, his family not washing
much laundry and the household managing water usage.
My initial correspondence of April 24, 2001 called for an "order for correction." Hence, since
conducting an on-site soils evaluation and Mr. Lippert's inspection I l�ave lifted my order for
correction. (Refer to letter dated August 20, 2001).

Mr. Rosenow admitted to pumping liquid sewage out of his vent pipe over a small hill and
adjacent to a wetland pond on April 23, 2001. He has not pumped any sewage since this date.
Adjacent neighbor, David Thomas, is a bit upset and claims that the sewage overflow may have
adversely affected his property. �
I am not a scientist, chemist nor environmental engineer, however I feel as though there have
been no adverse effects to Mr. Rosenow's nor Mr. Thomas' property.
My conclusions are as follows:
1.) Sewage was pumped out of Mr. Rosenow's vent pipe. The sewa�e was diluted because of
heavy rainfall. It flowed through a wetland pond, 30' wide, 70' Iong and 3' deep, flowed
down a roadside ditch some 620', crossed the town road onto Mr. Thomas' property.
2.) Mr. Thomas admitted Yo me that the ponding was approximately 90' from his well and that
his well is 90' deep.
3.) Mr. Thomas has conducted 2 well water quality tests, both tests are negative and show no
pollution or fecals.
In conclusion, Mr. Rosenow's septic/sewer system does not meet the definition of failure by
Connn 81.01(92). He does not have to replace it at this time, if and when it does fail, he has soil
tested another area for a replacement.

Dear Mr. Rosenow:
On Thursday August 16, 2001 we all met on your property to look at soils and an
altemate area for a replacement sewer.
Enciosed please find definition of a"failed sewer system". At this time you do NOT
meet the definition of a failed system and will not be ordered to install a new system.
However, I will still contend that there are the fol(owing unexplained things going on:
1). Possible clogging mat may be formed in the system.
2.) Recorded water levels consistently 8" — 12" with spikes of 20" — 24".
3.) Recent water levels of"0" inches?!!!
4.) It is highly unlikely that sewage will ever pond on the ground.
5.) If high-water recordings come up again, more than likely in due time may cause back
up into the dwelling.
Your sewer problems are much different than what I have ever encountered. Things are
going on that I can not explain. At least now you know that you have an altemate area
available from a sewer system, if and when the system fails.

RE: "Order for Correction" — failed syptic/sewer system, 8" — 13" of continuous ponding
water in septic bed.
Dear Mr. Rosenow:
On April 24 2001, I mailed you a detailed letter involving sewage pumpino and ordered
correction. I have met with you at least 6-8 times throughout the summer to check out
your violation as well as compliance to my violation notice. I have always received your
up most coope�ation and have no reason to suspect a continued violation of the order.
You have recorded the ponding sewage water in the vent stake 8" to 13" on a daily basis
since the violation. Yesterday Mr. Wellauer and I recorded the system elevation as per
plumbers plans. All appears to be code-compliant.
However, the continuous ponding indicated that a clogging-biomat has fortned on the
bottom and sidewalls of the septic bed causing the ponding. I do not know the exact
cause of the ponding, it is my professional opinion that the heavy rains and the back
wetland water level is not causing the failure of your septic bed. The back wedand water
level has receded due to lack of rain some 15" — 30" dowq yet the ponding water in your
septic bed has maintained a constant 8" to 13" level.
Investigating failed sewer systems and trying to identify causes of failure is at times
difficult and is not an exact science.
I have discussed potential causes of failure, asked your families living habits etc. The
soils aze correctly recorded, the system was installed in the proper locations and at the
correct elevation.
The causes of premature failure mavbe:
a.) excessive cloths washing
b.) excessive use of soap detergents ac�d additives
c.) tilling the gazden piot 8" — 10" depth over the septic bed.
d.) Planting the gazden over the septic bed
e.) Excessive watering of the garden
As I mentioned these are only thoughts of failure.
Finally, you have a failed sewer system that must be conected. I will issue an order for
correction to install a code-complying system on or before October 1, 2001.
I understand that you have contacted Ron Spreckels construction to do a soil test and
septic proposal.
