Pevan 15109 Chestnut Circle Burnsville, MN 55306 RE: Parcels -.6.12&13, Edgewater Beach Subdivision, S 26, T 41N, R 08W, Town of Hayward, #12752 W South Shore Road: Application for Variance Dear Mr. Pevan: I have enclosed the following documents with this letter: • Inspection Report for the above property, • "Court Decisions Regarding the Granting of Variances," • "Application for Variance - Additional Information," and a completed • "Variance Application." Please review the inspection report, read the summary on court decisions and complete the request for additional information. If you believe that you meet the criteria for the requested variance, you should review the variance application far correctness, sign it, and return it to this office with a check in the amount of$250.00 made out to the "Sawyer County Zoning Administration" by Friday, July 6, 2001 for hearings in August 2001. The "Application for Variance - Additional Information" must also be filled out and returned with the Variance Application. Both documents together make up the entire application that will be reviewed by the Sawyer County Board of Appeals. Failure to return both of the documents or failure to complete either document in its entirety will cause the variance application to be rejected by this office. The 50% current estimated fair market (CEFMV)rule applies in this situation as the cabin is a nonconforming structure—it is closer than 75' to the lake. The "50% rule" restricts the cost of improvements to a nonconforming structure to no more than 50% of the CEFMV of the structure. The 50% CEFMV for the cabin is $12,450. Construction costs exceeding $12,450 would require the prior approval of a variance by the Sawyer County Board of Appeals. The costs related to the 50% CEFMV are the costs of materials and labor to enclose an addition and to finish the interior of the addition (i.e., sheet rock). Costs related to plumbing, heating electrical, window and floor coverings etc.; are not related to the 50% CEFMV. If you do ultimately require a variance to exceed the 50% CEFMV, a contractor's estimate of material and labar costs must be in this office by Wednesday, August 8, 2001. . Your application will be reviewed at two public hearings. The first hearing will held by the Town of Hayward at 7:00 P.M., Tuesday, August 14, 2001. You should contact Jodi Longtine, Clerk, Town of Hayward, at(715) 634-4123 (office) or 634-4958 (home) to confirm this date. The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M., Tuesday, August 21, 2001 in the large courtroom located in the Sawyer County Courthouse. You or your representative should attend each hearing, especially the hearing conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant the variance, the decision of the Town of Hayward is advisory only. It is your responsibility to convince the Board of Appeals to grant the variance that you have requested. Therefore, you should consider using any means at your disposal (i.e., photographs, drawings, a good verbal presentation, etc.) as you present your facts to the Board.
