Dear Mary:
Enclosed is a copy of the inspection report for the Panther property. The average lake
setback was determined to be 68'from the ordinary high-water mazk(OHWM)of the
lake. Flags were set at this distance from the lake. Construction activities on the lakeside
of these flags would require the prior approval of a vaziance by the Sawyer Counry Boazd
of Appeals.
The 50%current estimated fair market(CEFMV)rule applies in this situation as the
dwelling is a nonconforming structure—it is closer than 75'to the lake and closer than
10'to an adjacent side lot line. The"50%rule"restricts the cost of improvements to a
nonconforming structure to no more than 50%of the CEFMV of the structure. The 50%
CEFMV for the dwelling and garage combined is$40,500. The 50%CEFMV for the
dwelling alone would be somewhat less this amount. Construction costs exceeding the
CEFMV would require the prior approval of a variance by the Sawyer County Boazd of
Appeals.
The costs related to the 50%CEFMV are the costs of materials and labor to enclose an
addition(i.e.,foundation,exterior walls and the roo�and to finish the interior of the
addition(i.e.,sheet rock). Costs related to plumbing,heating electrical,window and floor
coverings etc.;are not related to the 50%CEFMV.
Mary,upon returning to the office,Cindy and I calculated the average lot width for this
parcel. The average lot width is approximately 95'. This has no significance unless the
property owner decided to construct a replacement dwelling. In that situation,a variance
would have to be obtained as the Sawyer County Zoning Ordinance requires a minimum
average lot width oF 100'
