Bill Christman, Sawyer County Zoning Administrator, asked that I have you verify that this parcel would not be subject to the 100' setback that ali lots to the South of it are. I have enclosed maps and a title commitment for your review. tt shouid be noted that a boundary dispute existed conceming this property and only as a result of a new survey and not anything having to do with the previous ownership of the parcel or prior agreements between the DNR and Denny Johnstone, did a tiny sliver of this parcel fall within the DNR Covenants. The portion of the parcei that faiis within the covenats would not be invoived in any future development of the property. A short note to me verifying that the part of this parcel lying North of the West Y< line of Sec. 6, T40W, R6W, is not subject to the 100' setback would suce. A timely response would be sincerely appreciated. Piease call me at 715-634-3522 if you have any questions. Have a great day! Sincerely, Boyd Beley P.S. Please mail to: Dr. Boyd Beley P_0. Box 208 Hayward, WI 54843 Dear Dr. Beley: I have looked over the materials you sent me and have also checked legal descriptions of adjacent properties with buffer zone restrictions. Any propert located in the East half of the Northwest quarter of section 6, T40N, R.6W, Town of Hunter (Lot #1), is not encumbered by any restrictive buffer zone covenants or right of first refusal. There does appear to be several surveys that have moved the East/West quarter line over the years and there may be more movement in the future. Again, any part or portion North of the East/West quarter line in Section 6, specifically in the East half of the Northwest quarter is outside of the buffer zone covenants. Any portion of land south of the East/West quarter line in Section 6 (Lots 2, 3, and 4 of CSM#3712), is within the buffer zone covenants. In addition to the buffer zone covenants, the Department of Natural Resources does have right of first refusal on all properties south of the East/West quarter line in the Southwest quarter (lots 2, 3, and 4). Both the covenants and right of first refusal are in full force and are being applied to all encumbered properties. Hopefully this has answered your question. If you have any further questions please contact me. Sincerely, , John K Wickland Land Agent CC: Tim Miller - Ladysmith S.C.
