My understanding is that you would like to replace the collapsed storage building. I have also been told that you believe that a variance would be required for the new building. Based on my measurements you would be able to locate the new building on the property and meet all required minimum setbacks. The minimum required setbacks are: • 75' to the lake, • 5' to the adjacent side lot line and • 40' to the rear lot line. There is not a minimum setback requirement to the driveway. The issue is that I do not have a DNR approved 100-year flood elevation for Lac Courte Oreilles, however the FEMA Flood Insurance Rate Map indicates that part of this property is subject to flooding during a 100-year flood event. . During our conversation we agreed on the following: L The first floor of the home must be a minimum of four (4) feet above the ordinary high-water mark of the lake. 2. The building site would: a. Be approximately 150' to the lake, b. be off of the end of the existing driveway, c. meet the minimum rear lot line setback of 40' and d. meet the minimum side lot line setbacks of 10'/30' . Christman Zoning Administrator �� ,' _ - �, _.. � ��J J GUIDELINES FOR RESTORING NONCONFORNIING FLOODPLAIN � BUILDINGS DAMAGED IN A NON-FLOOD DISASTER For any nonconforming building in the floodplain damaged by a nonflood disaster, Wisconsin Act 4�� (Ch. 87.30 (ld), Wis. Stats.) permits the repair, reconstruction or improvement of the building in order to restore it to its pre-disaster condition. This Act authorizes such restoration only if the minimum requirements of the National Flood Insurance Program, under 44 CFR 60.3, are met. Both local and federal rebulations require that a Regional Flood Elevation (RFE) be determined before a land use permit can be issued for floodplain development. If the DNR is asked to furnish an RFE, it will be developed in accordance with the requirements of Ch. NR 116, Wis. Admin. Code. This could take up to six months, depending on workload. If the applicant decides not to request an RFE determination from the DNR, either a consulting engineer or the local zoning official can use the best available data to determine the RFE far the building site. To meet the floodproofing requirements, a registered engineer or architect must prepare the plans and certify that they�vill meet all applicable requirements. To fulfill the requirements of 44 CFR 60.3, the local zonin� official must ensure that the following procedures are followed: For Buildin�s in Unnumbered A Zone Areas— • Determine whether all required local, state and federal permits have been obtained and meet the applicable requirements; • Use the best available data to determine a RFE for the site; + Require all buildings to have the lowest floor (including basement) elevated to or abo��e the RFE; Require all buildinQs to be properly tloodproofed, �vhich could include but is not limited to: adequately anchored to prevent flotation, collapse or lateral movement of the structure, to be constructed usin� �vater-resistant materials and methods that minimize flood damages, and to elevate all service facilities above the RFE. The plans must be prepared and certified by a registered engineer or architect; • Require all water supply and onsite waste disposal systems to be properly floodproofed; • Assure that the flood carrying capacity of any affected watercourse is maintained. For Buildinas in Numbered A Zone Areas (RFE determined)— • All of the above shall apply; • Until a regulatory floodway is established, the applicant must demonstrate that the proposed development will not increase the RFE more than one foot at any point within the communit}�. This analysis must be prepared and certified by a registered engineer. This requirement can be waived if the new building footprint matches the old footprint; For Buildinas in Numbered A Zone Areas with Re�ulatory Flood�vav Determined— • All of the above shall apply; • Prohibit encroachments, includin� fill, new construction and other development within the floodway unless the applicant can demonstrate that the project will not cause an increase in the RFE. This analysis must be prepared and certified by a registered engineer. This requirement can be waived if the ne�v building footprint matches the old footprint; (3) Habitable area requiring exterior ingress/egress(i.e.,walkouts,doors, windows etc.)shall not be created. (d)Roof pitch may be increased for ventilation,snow-load or aesthetic purposes but may not create additional habitable area. (e) Mitigation may be required.See Section 4.419 MITIGATION for details. (� Standard erosion and storm water runoff control measures must be implemented. 5) Nonconforming structures within the shorelands which are damaged or destroyed by violent wind,ice,vandalism,fire or flood may be reconstructed provided: (a)Damage which is due to an intentional act of the owner may only be repaired in conformity with the ordinance. (b)The owner must establish by competent evidence the specific extent of damage to a structure and its improvements. (c) Repair and reconstruction are limited to that part of a structure and its specific improvements which were actually damaged and similar building materials are employed. (d)Repair and reconstruction are in compliance with all other provisions of applicable ordinances. (e)MITIGATION may be required. See Section 4.419 MITIGATION. (fl A land use permit is required. (g)Standard erosion and storm water runoff control measures must be implemented. 6) Existing nonconforming boathouses. The ORDINARY MAINTENANCE AND REPAIR of nonconforming boathouses that extend waterward beyond the ordinary high-water mark of any navigable waters shall comply with the requirements of s.30.121,Wisc Stats(Overwater Boathouses). 7) Nonconforming patios,screen porches and similar structures. _{a)�eneral:- _ - -- — - --- __ - _ __ _- - __ __ (1)Such structures are allowed ORDINARY MAINTENANCE AND REPAIR (2)Such structures shall be replaced only by variance. (b)Decks. (1)Decks may be replaced within the existing footprint. (2)Roofs shall not be constructed above decks.
