estimated fair market value. A variance (#95-066), was previously granted for additions to the existing
dwelling exceeding the then 50% of the current estimated fair market value.

Dear Dr.Holloway:
I have enclosed the following documents with this letter:
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance-Additional Information,"and a completed
• "Variance Application."
Please review the inspection report,read the summary on court decisions and complete
the request for additional information.
If you believe that you meet the criteria for the requested variance(s),you should review
the variance application for correctness,sign it,and retum it to this office with a check in
the amount of$250.00 made out to the"Sawyer County Zoning Administration"by
Friday,August 3,2001 for hearings in September 2001.
The"Application for Variance-Additional Information"must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
retum both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this offtce.
The"50%of current estimated fair mazket value rule"(50%RULE)applies in this
situation as the dwelling is a nonconforming structure it is closer than 75'to Whitefish
Lake and closer than 10'and 30'to the adjacent side lot lines.The"50%rule"restricts
the cost of construction to 50%of the dwelling's CEFMV. Construction costs related to
the 50%CEFMV are the costs of labor and materials to enclose and finish the interior of
your proposed addition. Costs related to plumbing,electrical,window and floor
coverings etc.,are not a part of the costs to be used when calculating construction costs
for 50%CEFMV purposes.
You must also have your builder provide a cost estimate (to include both materials and
labor costs) for the construction of the proposed addition to the Board. The information
shall be in the zoning office by Friday, September 14, 2001. You may also want to have
the information available for the Town of Sand Lake meeting.
Your "Variance Application" will be reviewed at two public meetings/hearings. The first
meeting will held by the Town of Sand Lake at 7:30 P.M., Tuesday, September 11, 2001.
You should contact Elaine Nyberg, Town of Sand Lake Clerk, at (715) 865-2486 (home)
to verify this information.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, September 18, 2001, in the Large Courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing especially the
hearing conducted by the Sawyer County Board of Appeals. Only the Board of Appeals
can grant the variance, the decision of the Town of Sand Lake is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.

Dear Mr. & Mrs. Holloway:
On December 19, 1995, the Sawyer County Board of Appeals approved your application
for a variance on the following described real estate to wit:
Part Govt Lots 1 and 2 S 14, T 39N, R 9W. Parcels :1.3 and
:2. 16. WD Vo1 449 Records Pg 471. Parcel size is 98' /130' x
343' containing .74 acres. Property is 2oned Residential/ '
Recreational 'hao. Application was for the raising of an existing
26' x 26' dwelling for the construction of a 26' x 26' full
basement and the addition of a 26' x 26' second story addition at
a lot line setback of 7 feet; and at a construction cost exceeding
50� of the current estimated fair market value. Variance is
requested as Section 18.4, Sawyer County Zoning Ordinance would
require a lot line setback of 10 feet; and Section 10.2 restricts
the cost of construction to less than 507 of the current
estimated fair market value. Town Board approved.
The Board of Appeals approved the application as submitted.
Findings of Fact of the Board of Appeals: There would be no change in the
use in the zone district. It would not be damaging to the rights of others
or property values.
Any person or persons jointly aggrieved by this decision of the Board of Appeals
may commence an action in the Circuit Court for Writ of Certiorari to review
the legality of this decision within 30 days after the date of this notice.
In future correspondence, or in applying for permits, please refer to Variance
95-066.
