Dear Vlr. �air:
I am writing this letter in regards to oor conversation on Tuesday July 3, 2001. We
agreed tl�at adjustments to the nonconformii�g deck would become code complying by
November 1, 2001. To be able Co meet the lake setback of 75' from the OHWM, 4' of the
12'deck must be removed, leaving an 8' deck from tl�e house.

Dear Mr. Magsam:
I have enclosed the following documents with this letter:
1. DNR letter dated October 28, 1999, Subject: "Special Zoning Permission" for
Structures in the Shoreland Setback Area
2. Sa��yer County Zoning Summary - Court Decisions Regarding the Granting of
Variances
3. Application for Variance— Sawyer County Board of Appeals Additional
Information
4. Shoreland Restoration/Preservation Agreement
As we discussed on the telephone, I do not believe that a variance would be granted by
the Sa��yer County Board of Appeals for a deck setback closer than 7S to the ordinary
high-��ater mark of Lac CouRe Oreilles. In fact, the Board members have clearly stated
that they do not want to hear variances for decks, patios etc, as they do not believe that
these or similar structures are necessary for the reasonable use of a property.
As we also discussed, it is possible that the provisions of s.59.692(lv), the "Gard Gazebo
le�islation" may provide an option for Mr. Fair that would allow him to retain that part of
the deck that is closer than 75' to Lac Courte Oreilles.

Dear Mr. Fair:
I have enclosed a completed "Variance Application" with this letter. If you believe that
you meet the criteria for the requested variance, you should review the variance
application for correctness, sign it, and return it to this office with a check in the amount
of $250.00 made out to the "Sawyer County Zoning Administration" by Friday,
November 2, 2001 for hearings in December 2001 .
Your "Variance Application" will be reviewed at two public hearings. The first hearing
will held by the Town of Bass Lake at 6:30 P.M., Monday, December 10, 2001 . You
should contact Shirley A. Miller, Town of Bass Lake Clerk, at (715) 634-2172 (home) to
confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, December 18, 2001, in the large courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the
hearing conducted by the Sawyer County Board of Appeals. Only the Board of Appeals
can grant the variance, the decision of the Town of Bass Lake is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
