Dear Mrs. Fenis:
Enclosed is a copy of the inspection report for the Everson's Nelson Lake Lodge
Condominium and Campground. I modified the condominium plat for the purpose of this
inspection.
Condominium related issues.
1. Number of condominium units allowed. The Sawyer County Zoning
Ordinance requires that the number of condominium units be based on minimum
lot and parcel requirements of the lake on which the condominium is located.
Nelson Lake is a Class One lake with minimum area requirements of 20,000 ft2
per condominium dwelling unit. There are presently 15 units (13 dwelling units
and two non-dwelling units - unit#8 a shed and unit#9 a garage) within this
condominium. The area allocated to the condominium is approximately 116,600
ft2 (44,600ftz+ 72,OOOft2 = 116,000 ft2). Therefore, based on 20,OOOft2 per
dwelling unit and the 116,600ft2 available, there would be only six (6) dwelling
units permitted on this property. The condominium contains seven (7) more
dwelling units then is allowed. The prior approval of a variance bv the Sawver
Countv Board of A�peals would be required to replace anv of the existin�
dwellin units.
2. 50% Current Estimated Fair Market Value (50%CEFMV, rule. Section 10.21
of the Sawyer County Zoning Ordinance states: No structural alteration,addition or
repair to any building or structure with a nonconforming use or any nonconforming building
or structure,over the life of the building or structure,shall exceed 50 percent of the building
or structure's current estimated fair market value unless it is permanently changed to conform
to the requirements of this ordinance.
A structure (i.e., condominium unit) is nonconforming if it fails to meet one or
more of the setback requirements of the zoning ordinance (i.e., closer than 75' to
the lake, closer than 20' to an adjacent unit etc.). Improvements to such a

structure would be limited to no more than 50%of the structure's current
esYimated fair mazket value(CEFMV). The costs related to the CEFMV would be
the combined cost of materials and labor to make the improvement. The prior
approval of a vaziance would be required to exceed the 50%CEFMV. Requests
for variances to exceed the 50%CEFMV for shoreland properties have not been
approved during the previous two years.
Current estimated fair market values for the condominium units are not available
from office records and must be obtained from the Town of Lenroot assessor.
3. Avera�e lake setback. Average lake setbacks were determined for each of the
lakeside units. Construction activities closer to the lake than the average lake
setback would require the prior approval of a variance. For example,if the
average setback for a unit were determined to be 45'from the lake,a vaziance
would be required to construct an addition on to the unit,any part of which would
be closer than 45'to the lake.
4. Ordinary repair and maintenance. All nonconforming structures aze allowed
ordinary repair and maintenance. Ordinary repair and maintenance would include
such as activities as replacing windows and doors,replacing siding and roof
shingles,painting,staining etc.). These activities are what any property owner
would do to maintain a structure in good repair. These activities do not result in
the expansion of a structure.
5. Minimum residential dimensional requirements. This property is in the
Residential/Recreational—Two(RR-2)zone district. The minimum residential
(dwelling unit)dimensional requirements for this zone district are:
A. Minimum residence width—20'.
B. Minimum floor area:
(1)One bedroom—SOOft�.
(2)Two bedrooms-600ftz.
(3)Three bedrooms-700ft2.
6. Individual unit situations.
A. Unit#1—one bedroom cabin(270ftz).
(1)Nonconforming
(a) Closer than 75'to the lake.
(b)Closer than 40'to rear lot line.
(c) Substandard in size.
(2)50%CEFMV rule applies.
(3)Average lake setback was determined at 58'. Unit located 20'-24'
from the lake. Prior approval of a variance is required for any
expansion of this unit.
(4)Ordinary repair and maintenance allowed.
B. Unit#2—two bedroom cabin (519ft2).
(1) Nonconforming
(a) Closer than 75' to the lake.
(b) Closer than 40' to rear lot line.
(2) 50% CEFMV rule applies.
(3) Average lake setback determined at 4T. Unit located 31' from the
lake.
(4) Ordinary repair and maintenance allowed.
C. Unit#3 —two bedroom cabin (608ft2).
(1) Nonconforming
(a) Closer than 7S to the lake.
(b) Closer than 40' to rear lot line.
(2) 50% CEFMV rule applies.
(3) Average lake setback determined at 47'. Unit located 43' from the
lake.
(4) Ordinary repair and maintenance allowed.
D. Unit#4—two bedroom cabin (518frz).

Campground related issues. � ��•J3�1��
The campground azea(identified as parcel .11.4, S 21, T 42N, R 09W, cont�i��.5A6 '�
acres. A par[ial list of the minimum requirements for a trailer camp or campground as
stated in Section 6.6 of the Sawyer County Zoning Ordinance aze:
1. Minimum IoUparcel size - 5 acres.
2. Maximum number of sites per acre— 15 per gross acre.
3. No site shall be less than 50' from the front, side, or reaz lot lines of the camp.
It is appazent that the campground is nonconforming. Alsq the ordinance requires a
conditional use permit(public heazing) for the creation of a new campground or the
expansion of an existing campground. This campground has been in existence since prior
to the adoption of the cunent Sawyer County Zoning Ordinance (adopted in 1971).
Therefore, the campground is "grandfathered" and will be allowed to operate as is
without expansion. However, any increase in the number of sites would require both the
approval of a vaziance (the site does not contain a minimum of five acres) and, assuming
the variance was approved, a public heazing by the Sawyer County Zoning Committee for
the approval of a conditional use and the issue of a conditional use permit. It is highly
unlikely that such a vaziance would be granted. I am enclosing a copy of Section 6.6
TRAILER CAMPS AND CAMPGROUNDS.
There was a question concerning the relocation of the campsites. This would be allowed
providing there was not an increase in the number of sites and the location of the sites
was in conformance with the setback requirements stated in the ordinance.

6.6 TRAILER CAMPS AND CAMPGROUNDS
All major recreational equipmenUvehicles and camping cabins must be located in
a Federal, State, County, Town, or in a privately owned campground; the plan of
which has been approved by the County Zoning Committee and appropriate
State agency.
6.61 Minimum lot or parcel size-five(5)acres
6.62 Maximum number of sites- 15 per gross acre
6.63 Each site shall be plainly marked and surfaced
6.64 All drives and parking areas other than those at individual sites shall be
surfaced, at least gravel surfaced.
6.65 Central toilet, shower, and washing facilities shall be provided in su�cient
quantity, as determined by the State Department of Health and Social Services
requirements. �
6.66 Water supply and the manner of sewage disposal shall comply with the
regulations of the Sawyer County Private Sewage System Ordinance and the
appropriate requirements of the Wisconsin Administrative Code.
6.67 No site shall be less than 50 feet from the front, side, or rear lot lines of the
camp.
6.68 Marshland and shoreline areas shall not be altered.
6.69 The screening provisions of Section 7.0 of the ordinance shall be met.
6.610 The construction, placement, installation or use of a camping cabin shall
be by land use permit issued only to licensed campgrounds. Camping cabins
shall not exceed 300 square feet in area; shall not exceed 12 feet in height; and
the connection to or installation of gas, water, or sewer shall be prohibited.
Camping cabins shall not have a second story or loft.

Proposed Amendment—4.25 LOT SIZES
4.25 LOT SIZES
1) After adoption of this ordinance, or an amendment thereto, no lot azea shall be so
reduced that the dimensional and yazd requirements required by this ordinance cannot be
met.
2) If one or more substandazd lots with continuous frontage have the same ownership as
of the effective date of this ordinance (March 26, 1971), the lots involved shall be
considered to be an individual parcel for the purposes of this ordinance.
3) Property owners are responsible for determining when their lots were
created.
4) Lots existine and of record arior to March 26, 1971.
Lots existing and of record, (i.e. documented by the recording of a metes and bounds
description; or a Certified Survey Map; or a recorded platted subdivision), but of
substandazd size, may be devoted to uses permitted in the district in which located
provided that:
(a) If not served by a public sewer, the lot—
1. Contains at least 10,000 square feet and
2. Has an average lot width of 65 feet
(b) If served by a public sewcr, the lot-
1. Contains at least 7500 square feet and
2. Has an average lot width of 65 feet
(c) All minimum setback and private onsite wastewater treatment system
requirements shall be met.
(d) The proposed use is permitted in the zone district in which the lot is
located.
(e) The lot is in separate ownership from adjacent parcels.
(� A land use permit for improvements to a lot not meeting the
requirements of 2)(a)-(c) above shall be issued only after the granting of a
variance by the Sawyer County Board of Appeals.
5) Lots created from March 26 1971 to Aaril 15, 1991. Such lots shall meet the
minimum dimensional standards effective on March 26, 1971. Lots created by
metes and bounds descriptions or the recording of Certified Survey Maps shall be
considered to be dimensionally conforming lots for the lot's zone district at the date
of the recording of the deed or CSM with the Sawyer County Register of Deeds.
6) Lots created from Anri116 1991 to Julv 20, 1995. The April 16, 1991
amendment to the Sawyer County Zoning Ordinance changed the Forestry One (F-
1) zone district minimum requirements from a lot area of 20,000 square feet and a
lot width of 100 feet to a minimum of 5 acres and 300 feet respectively. Lots in the
F-1 zone district created prior to April 16, 1991 shall be considered to be
conforming parcels as long as they remain in the F-1 zone district.

Mr. Johnson:
The answer is "no" unless a variance would be granted by the Sawyer County
Board of Appeals. It is highly unlikely that this variance would be
approved. The most recent similiar situation that the Board addressed was
on September 17, 2002 where the Board heard a request for variance to
replace an existing condominium unit in a Round Lake condominium. The
request was to replace a unit in the same location to the exact dimensions
and at 40' from the lake. The Board denied the request.
The Board decided that the owner should keep his unit in the best possible
repair but not plan on ever expanding or replacing it.
The circumstances with Unit#1 are much more severe than with the above
situation in that Unit#1 is as close as 20' to the lake. Numerous
potential purchasers have contacted me about the issues with Unit#1. My
advise has been, if the purchaser is satisfied with the unit as it is now
then purchase should be a consideration; however, do not plan on replacing
the unit or expanding it in any direction (to the sides, second story
addition or basement).
