RE: Pazcel :2.16, S 14, T 38N, R 07W, Town of Radisson: Violations of the Sawyer
County Zoning Ordinance: (1) Construction of a Detached Garage and a also Deck
Addition onto an Existing Dwelling, Without the Issue of Land Use Permits
($396.50) and (2) the Construction of the Garage and Deck too Close to Navigable
Water- Variance(s) had not been Granted - (535�.00)
Dear Mr. Evenson:
On Friday, June 22, 2001 personnel from this office visited your property regarding the
matter of a garage and deck addition having been constructed too close to Radisson
Flowage and without the issue of Land Use Permit(s) by this office. It has been
determined that violations of the Sawyer County Zoning Ordinance exist with the
construction of these two structures:
(1) Construction of a detached garage and also a deck addition onto an existing
dwelling, without the issue of Land Use Permits - ($396.50) and
(2) the construction of the garage and deck too close to navigable water—
($355.00)
Citations shall be issued for these violations with the recommendation that both the
garage and the deck be removed by October 1, 2001.
Mr. Evenson, the history� of this property is that a variance (#95-014) was amended on
May 19, 1998 for the construction of a 28'x48' dwelling centered on the lot. This
approval did not include either a deck or a detached garage. A Land Use Permit (#98-
604) was issued on October 20, 1998 to you and Jeff Nerby for the construction of the
dwelling only.

On May 19, 1998, the Sawyer County Boazd of Appeals approved a variance on the
following described real estate to wit:

Records Page 65. Property contains 1.53 acres. PropeRy is zoned
ResidentiaURecreational One (RR-1). Variance #95-014 was approved for
this pazcel at a public heazing held 21 Mazch 1995.
The Boazd oF Appeals approved the construction of a 28'x48' dwelling, centered in the
lot.

Dear Mr. & Mrs. Favorite:
On Tuesday, April 18, 1995, the Sawyer County Board of Appeals approved with
changes your application for a variance on the following described real estate
to wit:
Part Govt Lot 2 S 14, T 38N, R 7W. Parcel :2.4. Vol 545
Records Pg 172 . Parcel size is 1 .53 acres. Property is
zoned Residential/Recreational One. Application is for the
construction of a 36'x 40' dwelling at a waterline setback
of 60 feet from the normal highwater mark of the Radisson
Flowage. Variance is requested as Section 4.49, Sawyer
County Zoning Ordinance, would require a waterline setback
of 75 feet from the normal highwa[er mark of the flowage.
Village Council, Village of Radisson, has approved. Town
Board has approved.
The application was tabled by the Board at their March 21st
public hearing, as the applicant was not present. Applicant
was notified to present an alterna[e plan.
The Board of Appeals amended to a11ow a 26'x 50' dwelling to be built in the
triangle area located on the inspection report. Keep the 75' setbacks.
Findings of Fact of the Board of Appeals: It would not be the basis of economic
gain or loss. There would be no change in the use in the zone district . It
would not be damaging to the rights of others or property values. It woulc
be due to special conditions unique to the property.
Any person or persons jointly aggrieved by this decision of the Board of rlppeals
may commence an action in the Circuit Court for Writ of Certiorari to review
the legality of this decision within 30 days after the date of this notice.
In future correspondence, or in applying for permits, please refer to Variance
95-014.
