Dickerson N5092 Lake Winter Rd SO Winter, WI 54896 RE: Parcel .14.2, S 34, T 39N, R OSW, Town of Winter: Violation of the Sawyer County Zoning Ordinance - Addition Constructed Too Close (Less than 10 feet) to an Adjacent Side Lot Line Dear Mr. Dickerson: Enclosed is a copy of the inspection report based on my visit to your property on Mazch 27, 2001. The purpose of my visit was to address the issue of a dwelling addition (LUP #99-150)having been constructed closer Yhan 10 feet to the adjacent side lot line. Plat of Survey dated February 21, 2000 indicates both a dwelling encroachment of 3.92 feet onto the adjacent property and an addition setback of less than 10 feet to the side lot line. The Sawyer County Zoning Ordinance requires that the minimum side lot line setback be no less than 10 feet for the construction of either a dwelling or a dwelling addition in the Residential/Recreational Two (RR-2) zone district. I shall be issuing a citation in the amount of$335.00 for construction of the dwelling addition closer than 10 feet to the side lot line. I shall also recommend that the dwelling encroachment and addition setback matters be resolved by eiYher the purchase of additional adjacent property or the relocation of the dwelling with addition. I shall also indicate on the citation that this matter is also the subject of a civil action. Please contact this office if you have any additional questions or comments. Please be advised that this dispute is the subject of a civil action captioned as Marinack, . et al. v. Dickerson, et al., case no. OOCV 13, Sawyer County. At this time, Sawyer County is not a party to that action. I represent Anthony Marinack, et al., the owners of real property located directly to the east of real property owned by William Dickerson and Sonja Dickerson. The Dickersons reside at N5092 Lake Winter Road, Town of Winter, Sawyer County. This is the site of the asserted violations. The property is zoned RR-2. In approximately 1990, the Dickersons caused a residential dwelling to be constructed on their property. According to your office, there is no record of any land use permit requested for the building of this structure. Therefore, one can only conclude that the Dickersons did not obtain a land use permit from Sawyer County prior to the construction of their house in violation of Sawyer County Ord. § 9.21(1). On or about Apri129, 1999, the Dickersons applied for a land use permit in order to construct an addition to the aforementioned house (See Attachment A enclosed). The application erroneously indicated that the addition would be set back from the neighboring property to the east by a distance of 100 feet. The land use permit was granted on May 3, 1999 based on the information provided by the Dickersons and the addition was constructed shortly thereafter. Sawyer County Zoning Department March 19,2001 Page 2 According to a survey performed as to the Dickersons'east property line in Feburary, 2000(See Attachment B enclosed),the house and the addition violate the ten foot setback requirements set forth at Sawyer County Ord.§ 18.4. Moreover,the Dickersons'house actually encroaches onto the neighboring property(my clients)by a distance of 3.92 feet. Plaintiffs in the above-entitled action, by and through counsel, hereby complain and allege as follows: GENERAL ALLEGATIONS l . Defendants are individuals residing at N5092 Lake Winter Road, Town of Winter, Sawyer County, state of Wisconsin. 2. Plaintiffs are individuals and are the owners, as joint tenants, of real property (hereinafter "Plaintiffs' property") located in the vicinity of Winter, Wisconsin and which was conveyed to Plaintiffs pursuant to a warranty deed dated June 10, 1991 , recorded in the Sawyer County Recorder's Office at Volume 466 of Records Page 390 on June 17, 1991 described as follows: That part of the North Half of the Southeast Quarter (N 1/2 SE 1/4), section Thirty-four (34), To�vnship Thirty-nine (39) North, Range Five (5) West, described as follows:Commencing at a point 33 feet South and I500 feet West of the East quarter corner of said Section 34;thence at right angels South,a distance of approximately 1310 feet to the South line of said N 1/2 SE 1/4;thence at right angles East on said South line,a distance of 300 feet;thence at righ[angles NoRh, a distance of approximately 1310 feet to a point on the South line of the Town Road;thence at right angles West,along said South line of the Town Road,a distance of 300 feet. 3. Defendants are in possession of real property(hereinafter"Defendants' property")which is located geaerally to the west of Plaintiffs'property and which adjoins Plaintiffs'property. 4. On information and belief,Defendants claim possession of Defendants'property pursuant to a�varranty deed dated September 15, 1988,recorded in the Sawyer County Recorder's Office at Volume 425 of Records Page 235 on October 10, 1988 described as follows: That part of the Northwest Quarter of the Southeast Quarter,Section 34, Township 39 North,Range 5 West,described as follows:Beginning at a point on the south line of the town road 1500 feet West of the east line of said Northwest QuaRer of the Southeast Quarter;thence South,parallel with said East line 1337 feet;thence West 100 fee[;thence North, 1337 feet thence East;along the town road, 100 feet to the point of begi�ning. � 5. On information and belief,at the time Defendants came into possession of Defendants'propeRy in 1988,the property was vacant. 6. In approximately 1990 Defendants caused a residential dwelling(hereinafter "Defendants'house")to be constructed on Defendants'property. 7. Defendants did not obtain a land use permit from Sawyer County prior to the construction of Defendants'house. 8. According to a survey performed in February 2000,Defendants'house encroaches approximately four feet onto Plaintiffs'property. (Exhibit A.) 2 9. At approximately the same time Defendants caused Defendants' house to be constructed, Defendants or their agents cleared the area to the east of Defendants' house for a yard and lawn. 10. The aforementioned yard and lawn, or portions thereof, are located on Plaintiffs' property. 11 . Defendants have placed other structures and personal property of Defendants on Plaintiffs' property. 12. Neither Plaintiffs nor Plaintiffs' predecessors in interest gave permission to Defendants for Defendants to cause a structure to be built which encroaches on Plaintiffs' property. 13. Neither Plaintiffs nor Plaintiffs' predecessors in interest gave permission to Defendants for Defendants create a yard and lawn which encroaches on Plaintiffs' property. 14. In approximately April 1999, Defendants applied to the Sawyer County Zoning Administrator for a land use permit for a 16 foot by 24 foot addition to Defendants' house. 16. The aforementioned application signed by Defendants represented that the distance from Defendants' proposed addition to Plaintiffs' property was 100 feet. 17. The aforementioned representation �vas false. 3 18. Based on Defendants'application,the Sawyer Counry Zoning Administrator issued a land use permit ro Defendants on May 3,1999. 19. Defendants caused the aforementioned addition to be constructed during 1999 and/or2000. 20. Structural portions of the addition are less than ten feet from the east boundary of Defendants'property. 21. Defendants did not have a survey of Defendants'property performed prior to building Defendants'house in 1990. 22. Defendants did not have a survey of Defendants'property performed prior to building the addition to Defendants'house in 1999-2000. 23. Plaintiffs have entered into a contract to sell Plaintiffs'property to a third party. 24. The aforementioned third party has stated that it will not close the sale transaction until the present matter regarding Defendants'encroachment is resolved. FIRST CAUSE OF ACTION (EJECTMENT) 25. Plaintiffs reallege and incorporate the allegations of paragraphs 1 through 24 of this complaint. 26. Plaintiffs are the owners in fee simple of real property as described in paragraph 2 of this complaint. 27. Plaintiffs have the right to possession of Plaintiffs'property based on title and right,and therefore,Plaintiffs are entitled to possession of such property. 28. Plaintiffs have been entitled to possession of said property from 1991 until present. 4 29. Defendants unlawfully withhold possession of certain portions of Plaintiffs' property. Specifically, Defendants' house encroaches approximately four feet onto Plaintiffs' property. (See Exhibit A (copy of February 21 , 2000 survey).) 30. Plaintiffs demand possession of Plaintiffs' property. 31 . Plaintiffs demand damages in an amount to be determined at trial. 32. WHEREFORE, Plaintiffs request judgment as follows: A. That Plaintiffs be given immediate physical possession of Plaintiffs' property. B. That Defendants be ordered to remove any and all portions of Defendants' structures which encroach on Plaintiffs' property or which otherwise interfere with Plaintiffs' right to possession. C. That Defendants pay the costs of this action including reasonable attorney fees. D. Such other relief as the Court finds appropriate. SECOND CAUSE OF ACTION (PHYSICAL INJURY TO, AND INTERFERENCE WITH, REAL PROPERTY) 33. Plaintiffs reallege and incorporate the allegations of paragraphs 1 through 32 of this complaint. 34. Plaintiffs are the owners in fee simple of real property as described in paragraph 2 of this complaint. 35. Plaintiffs have the right to possession of Plaintiffs' property based on title and right, and therefore, Plaintiffs are entitled to possession of such property. 36. Plaintiffs are the only persons entitled to such possession. 5 ,. . 37. Plaintiffs' interest in their property has been harmed by Defendants' unlawful and unprivileged intrusions, encroachments, uses, and trespasses onto Plaintiffs' property. 38. Plaintiffs have suffered damages due to Defendants' unlawful interference with and physical injury to Plaintiffs' real property. 39. WHEREFORE, Plaintiffs request judgment as follows: A. That Defendants be enjoined from further interference, encroachment, or physical injury to Plaintiffs' property. B. That Plaintiffs be awarded damages in an amount to be proven at trial. C. That Defendants pay the costs of this action and reasonable attorney fees. D. Such other relief as the Court finds appropriate. THIRD CAUSE OF ACTION (TRESPASS TO LAND) 40. Plaintiffs reallege and incorporate the allegations of paragraphs 1 through 39 of this complaint. � 41. Defendants have intentionally entered on Plaintiffs' real property, thereby intruding. 42. Defendants caused a structure to be placed on Plaintiffs' real property, thereby intruding. 43. Defendants' entry and intrusion was wilful, intentional, unprivileged, and without Plaintiffs' permission or consent. 44. Defendants continue to intrude and Defendants' structure continues to remain on Plaintiffs' land without Plaintiffs' permission or consent. 6 45. Plaintiffs have been damaged by the invasion of Plaintiffs' possessory interest in the property. 46. WHEREFORE, Plaintiffs request judgment as follows: A. That Defendants be enjoined from further trespass and intrusion on Plaintiffs' property. B. That Plaintiffs be awarded actual damages and exemplary damages in the amount of$100,000.00 or such other amount to be proven at trial. C. That Defendants pay the costs of this action and reasonable attorney fees. D. Such other relief as the Court finds appropriate. FOURTH CAUSE OF ACTION (VIOLATION OF ZONING LAWS) 47. Plaintiffs reallege and incorporate the allegations of paragraphs 1 through 46 of this complaint. 48. Sawyer County Ordinances prescribe a minimum setback requirement of ten feet for the construction of residential dwellings. - 49. Defendants' structure is in violation of the setback requirement as it relates to the boundary between Defendants' property and Plaintiffs' property. 50. WHEREFORE, Plaintiffs request judgment as follows: A. That Defendants be ordered to remove the portions of Defendants' structures which exceed the setback requirements set forth in Sawyer County Ordinances. B. That Defendants pay the costs of this action and reasonable attorney fees. C. Such other relief as the Court finds appropriate. 7 FIFTH CAUSE OF ACTION (NEGLIGENCE) 51. Plaintiffs reallege and incorporate the allegations of paragraphs 1 through 50 of this complaint. 52. Defendants owed Plaintiffs a duty of care with regard to Defendants construction in the vicinity of Plaintiffs property. 53. Defendants breached their duty of care by causing the construction of a building which encroaches on Plaintiffs' property and which continues to encroach on Plaintiffs' property. 54. Plaintiffs have been damaged by Defendants' negligence. 55. WHEREFORE, Plaintiffs request judgment as follows: A. That Defendants be ordered to cease rendering damage to Plaintiffs' property by removing the encroaching structures on Plaintiffs' property; B. That Defendants be ordered to compensate Plaintiffs' for the injury to Plaintiffs' property in an amount to be proved at trial; - C.
