The 50% current estimated fair mazket (CEFMV) rule applies in this situation as the building is a nonconforming structure—it is closer than 75' to the lake. The"50% rule" restricts the cost of improvements to a nonconforming structure to no more than 50% of the CEFMV of the structure. The 50% CEPMV for the cabin is $13,850. Construction costs exceeding $13,850 would require the prior approval of a variance by the Sawyer County Board of Appeals. The costs related to the 50% CEFMV are the costs of materials and labor to enclose an addition and to finish the interior of the addition (i.e., sheet rock). Costs related to plumbing, heating electrical, window and floor coverings etc.; are not related to the 50% CEFMV. The average lake setback for the building is 75' from the lake. Any construction activities (i.e., additions to the building) that would be closer than 75' to tbe lake would require the prior approval of a variance by the Sawyer County Board of Appeals. It is apparent that the entire building is located cIoser than 75' to the lake; therefore, any additions/improvements to the building would require approval of a variance. Ordinary repair and maintenance is allowable for this building. This would include such activities as replacing siding, roof shingles and exterior windows and doors, and painting or staining of the building. Structural changes such as roof or foundation replacement/alteration must meet the 50% CEFMV criteria. In summary, this building is severely nonconforming. Therefore, while ordinary maintenance and repair is certainly allowable, structural changes are limited by the 50% CEFMV and variance approval requirements.
