Zink PO Box 10623 White Bear Lake, MN 55110 Re: Creation of Habitable Area within a Detached Garage, LUP #O 1-413: 12860 W County Highway 00 Dear Mr. Zink: Today it was brought to my attention that the detached garage located on your property at 12860 W County Highway 00 is being remodeled to include habitable living area. The creation of habitable living area in this garage would be a violation of the Sawyer County Zoning Ordinance. The following ordinance definitions are applicable to this situation. ACCESSORY STRUCTURE OR USE: A detached subordinate structure or a use which is clearly incidental to, and customarily found in connection with,the principal structure or use to which it is related, and which is located on the same lot as the principal structure or use. DWELLING iJNIT: A building or portion thereof with rooms arranged, designed,used or intended to be used for one family. Guesthouses with kitchen and bathroom facilities;and any accessory structures with a HABITABLE LIVING AREA are considered to be dwelling units. HABITABLE LNING AREA: The enclosed floor area arranged for living or sleeping. The area can include multiple levels of an existing structure. The area does not include decks,open porches, garages or overhangs. Your garage is an accessory structure in that it supports the uses within the home—the principal structure on the property. If the garage is converted to contain habitable living area the garage then becomes a second dwelling unit (home) on the property. This can be done only if the garage/dwelling unit is located on its own lot. Additionally, a land use permit would be required to be issued by this office if the use of the garage is changed to that of a dwelling unit.
