Dear Mr. Kelsey:
I just spoke to Mr, Johansen, who advised me of the substance of the meeting that
he had with you today, Appazently,the zoning administrator does not want to issue a
permit,preferring to simply send a letter indicating that we don't need a permit to resolve
this litigation.
VIr. Christman incorrectly assumes that the only reason�ve had for requesting the
permit was to resolve the Counry's claim against Mr. Johansen. My client seeks not oniy
to remove gravel,but to 3ea�e grave] in place which will constitute a driveway, and we
have asked for the necessary permit to do this 511ing under section 4.411. We do not seek
only io resolve the Counry's claim.
Obvzously, Mr. Johansen embarked upon this entire project as part of a]arger plan
to cons�uct his residence upon this lot. When this is all o��er, he expects to have
ConShuCted that hou5e, Obtain�ng apprqval of the driveway is a necessary part of this
process, for which Mr. Johansen has filed the appropriate request with the County far a
peimit. I would expect that Mr. Christman will review that application in the ordinary
course ofbusiness and issue the requested permit if Mr. Johausen is entitled to receive it.
My review of the County ordinance does not indicate that Mr. Christman has the
option of condirioning the issuance of that permit upon the priar receipt by Mr. 7ohansen
of any other permits that may or may not be available from DNR oz the Corps of

Engineers. Even if other pemtits aze required, it does not appear to be Mr. Christman's
responsibility to assure that we comply with those other requirements. If other permits ar
approvals are required, wc will do what wc necd to do to obtain them. It would be both
arbitrary and capricious for N1r. Christinan to base a denial of the requested permit upon
any criteria not specifically set forth in the County ordinance. Such a denial would be
appealable to the Board of Adjustment and to the Courts if necessary.
If N1r. Christman believes that we have not met the requirements of the County
ordinance for the permit under section 4.41], then he should deny the request, settin�
forth his reasons, in writing, as to why we az�e not entitled to the requested permit. 'VVe
would then be able to file an appeal to the Boazd of Adjustment and then co the Courts.
I may be cnisunderstanding b1r. Christman's position as to the issuance of this
permit. So far, I have been toid only that the permit is not being issued because we do not
need it to resolve the citation. If there is some objection to this applicarion under the
ordinance, I would be happy to review Mr. Christtnan's concems and tu procccd
accordingly. Barring that,however, we have requested a permit, and it should be acted
upon as is appsopriate undex county ordinances. Tt is our inteneon to resolve Mr.
7ohansen's right ta have a driveway. While Mr. Christman may want to keep this
quesrion unanswered, we believe that we are entided to a resolution at thio time.

I am writing to confirm our telephone conversation of July 26, 2000, relative to my
client, Mr. Charles Johansen. In that conversation, we discussed a number of things.
First, �ve discussed the fact that the wetlands delineation provided by my client
indicates that, while he did engage in a fill of weflands, they involved a total wetland fill
of only .14 acres. You acknowledged that a fill of that size would qualify for treahnent
under Nationwide Permit 26, which was in effect in 1998 when the fill occurred and
would therefore still be applicable to the resolution of this matter.
I advised you of my understanding that the letter sent by �1r. NSichael A. Keisey,
Acting Sawyer County Corporation Counsel, to Attorney Thomas W. Duffy, dated
February 8, 2000, has been accepted by both Mr. Johansen and Sawyer County as the
terms for his remediation and resolution of the citation issued to NIr. Johansen by Sawyer
County.
I asked you if Mr. Johansen would require a permit from the Corps in order to
excavate the gravel from the site, as provided in Mr. Kelsey's letter of February 8, 2000,
and you advised me that no Corps permit is required for excavating soil from a wetland. I
asked you to provide me with a letter to that effect so that I could forward it to
Corporation Counsel for his use in counseling the County as to issuance of a permit to
remove that b avel, and you indicated that you thought that you could issue such a letter
fairly quickly.

I also asked you to write a letter withdrawing the Corps' letter to Mr. Johansen
dated July 20, 1998, and based that request upon the following representations:
• Mr. Johansen's agreement with Sawyer County for remediation and dismissal of
its citation to him.
• DNR's withdrawal of its earlier citation to Mr. Johansen
• The fact that my client filled less than 1/3 of an acre, �,vhich �vould bring him
within the purview of Nationwide Permit 26, which requires that he notify the
Corps following completion of the project and which further requires that Mr.
Johansen obtain DNR water quality certification.
You indicated that it appeared that you would be able to �vrite this letter as �vell,
but did state that it would have to be reviewed by the Corps' office in St. Paul before
bein� sent out. Please understand that I am advising Corporation Counsel for Sawyer
County of our conversation and am providing him with a copy of this letter. If I have
inaccurately reported the substance of our conversation, I would ur�e you to notify me
immediately. I would not �vant to misinform any party to this transaction of the substance
of our communications.

Re: Application for Land Use Permit of Charles Johansen to construct a
dnveway to a building site on property located in the SW 1/4 of the SW 1/4,
Sec.25, T42N, R9W, Town of Lenroot, Sawyer County, WI.
Dear Mr. Christman:
Please find enclosed our Application for a permit to fill, grade and excavate, and
to construct a driveway, pursuant to Section 4.411 of the Sawyer County Zoning
Ordinance. We are requesting that the County issue a permit enabling us to remove
gravel from approximately .06 acres of land which lies within the wetland delineation
provided by Natural Resources Consulting, Inc. which was previously placed on this lot
without the necessary permit. This gravel would be relocated to higher ground on the lot,
as shown upon the proposal of Natural Resources Consulting, Inc.
Under the settlement agreement with the Corporation Counsel for the County, the
gravel needed for a driveway, covering .08 acres delineated as wetland, will remain as
the driveway to serve the future building site upon this lot. This pertnit is requested as
part of the resolution of Sawyer County Case No. 98-FO-87. Corporation counsel has
directed us to obtain this permit to remove and relocate the gravel from this lot, while
leaving the driveway of .OS acres, as a part of the settlement of that case. In order to
comply with this requirement, we must obtain a permit to do this excavation, grading and
filling and to construct this driveway, which leads to our filing this application.
As you know,although the property does contain a small wetland,the property is
not located within a Sawyer County Wetland-Shoreland zoning district,because it does
not appear upon the State of Wisconsin Wetland Inventory Map as a wetland of 5 acres
or more in size. Consequently,compliance with Section 17.9 is not required.
Construction of a driveway is a permitted use within the applicable zoning on this parcel,
provided that we apply for and obtain the necessary permit under Section 4.411,because
of the proximity of the azea to be excavated to Nelson Lake.
We believe that the enclosed application meets the requirements of Section
4.411(4). We would be happy to discuss any concerns that you may have,however,
regarding the adequacy of ow plan to wntrol erosion,sedimentation and impairment of
fish habitat. Please contact me or my attorney at your convenience if you wish to discuss
