As you know from our discussions last week, it is my opinion that a replacement dwelling is being constnzcted on your property. I base my opinion on (1) my observations during two visits to the properiy and (2) my interpretation of the Sawyer County Zoning Ordinance. On-site observations (Thursday, October 10, 2002 and Friday, October 11, 2002): This is a four-walled dwelling. All of the exterior walls above the foundation are new. This includes the addition wall (LUP#01-530) and the lakeside wall that I gave you verbal permission to replace. In addition, the two other "old" walls have also been replaced. If all of the new building materials above the foundation were to be removed, the only exterior wall (or any wall for that matter) from the "old" dwelling that would xemain is a section of"old" exterior wall - now an interior wall. This, in my opinion, constitutes a replacement dwelling. Sawyer County Zoning Ordinance: Section 2.0 Definitions (2) states: (2) ADDITION (Non-conforming Parcel): New construction performed on a building which increases the outside dimensions of the building. A minimum of 75% of the exterior wall area of the existing building must remain in place as exterior walls after completion of construction activities. Construction activities resulting in less than 75% of existing wall exterior area remaining in place, in total, shall be considered to be new/replacement construction. This is pertinent fo your situation as this parcel is nonconforming. VJhile the parcel (lots 8-10) meets the minimum 100' width requirements (actually 150') and minimum area requirement of 20,000 square feet 9actually 23,261 square feet), the parcel does not meet the minimum depth requirement of 200'. Options available: During our discussions, I presented what I consider to be your options from a zoning perspective. , Option #1 : Apply for a variance to keep the dwelling in its present location. Option #2: Move the dwelling 18' towards Poplar Lane to meet the lake (75') and road (63' from centerline) setbacks. Todd, I am not sure that this is any longer an option. During the visits I had a copy of LUP 01-530 with me. The permit indicates that the dwelling is 85' from the road. After looking at my June 2000 inspection report, it appears that the dwelling is actually 72' from the centerline of Poplar Lane. If my inspection report is correct, even if the building were to be moved towards Poplar Lane 18' to meet the lake setback (57' + 18' = 75'), it would only be 55' from the centerline of the road. A variance would be required for the 55' vs. 63' road setback. O tip on #3: File an administrative appeal with the Sawyer County Board of Appeals stating that you disagree with my decision that the dwelling now constitutes a replacement structure. The Board would hear each of our arguments and then decide if I have made an error in interpretation/judgement. As you know, I felt that it was important for you to receive a second opinion about this situation. It is for this reason that I asked Arvid Vallem, Chairman, Sawyer County Board of Appeals, to meet with us on the property. We met with Mr. Vallem the afternoon of Friday, October 11, 2002.
