(LUP) #97-534
Dear Mr. Strabel:
This morning I visited your property regazding a complaint that a building had been
constructed without the issue of a Land Use Permit. I observed a two-story gazage on the
property and a concrete block foundation. Upon retuming to the office and researching
office files I concluded that the issue is not the lack of a Land Use Permit, but the fact
that an issued Land Use Permit (#97-534) has expired.
Mr. Strabel, this office issued land Use Permit#97-534 on October 2, 1997 for the
construction of a dwelling with basement, and a detached gazage. The permit expired on
October 2, 1998. The Sawyer County Zoning Ordinance requires that new dwellings
must be completely enclosed within one year of the issue of a Land Use Permit.
Obviously, the construction of your dwelling was not completed by the expiration date of
LUP #97-534. This office does have a policy of extending the expiration date of new
dwelling permits for up to six-months if requested by the property owner.
The Sawyer County Zoning Ordinance also prohibits the construction of accessory
buildings (i.e., gazages, storage buildings, pole buildings etc.) on vacant property.
Without the associated dwelling, your garage is an accessory building on vacant property
- a violation of the Sawyer County Zoning Ordinance. Additionally, it appeazs that the
garage is being used for habitation purposes (i.e., the garage is heated and appeazs to
contain fumiture).
Mr. Strabel, I believe that the following options apply in this situation.
1. Make application to this office for another Land Use Permit for the
completion of the construction of the dwelling, or
2. Convert the gazage to a dwelling or
3. Remove the gazage from the property.
If you should decide to apply for a new permit, the application, with fee, must be in this
office by Friday, January 5, 2001. If you make application, I will approve the application
with an expiration date of July 30, 2001. T'his is less than one normal one-yeaz, but more
than the typical six-month extension. I believe that you should be able to have a dwelling
enclosed by that date. Failure, to make application by that date will cause me to issue an
order for the removal of the garage from the properry.
If you should decide to convert the gazage to a dwelling, you would also require a Land
Use Permit from this office, as this would be a change in the use of an accessory building.
In addition, you would require a Uniform Dwelling Code Permit from the Town of Bass
Lake and on-site inspections by the Town of Bass Lake Building Inspector. The UDC
permit and inspections would also apply to the construction of your new dwelling as the
Town of Bass Lake has adopted the State Uniform Dwelling Code since you made the
originai application(1997) for the construction of your dwelling.
