Vol 357 Records Page 163. Ap- proximately 130'x250' containing 2.51 acres. Property is zoned Residential/Recreational One. Application is for the construcYion of a 28'x45' second story addition onto an exist- ing dwelling at a setback distance of 37' (eave setback) to the ordinary high-water mark of the Chippewa River/Barker Lake. The proposed addition will be constructed no closer to the ordinary high-water mark than the existing dwelling. Variance is requested as Section 4.49(3), Sawyer County Zoning Ordinance, would require a minimum setback distance of 40' as the average setback was determined at that distance from the river/lake. The Town Board has approved the application. The Sawyer County Board of Appeals approved the application as follows: 2-year expiration date. Findings of Fact of the Board of Appeals: It would not be the basis of economic gain or loss. It would not be a self-created hardship. There would be no change in the use in the zone district. Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence an action in the CircuiY Court for Writ of CerCiorari to review the legality of this decision within 30 days after the date of this notice.
