Conservatee.
This matter came duly on for hearing before the above named Court on May 1,2002,on the
petition of Mary L.Roberts seeking appointment of a successor conservator for the estate of Gary
Forde,the above named conservatee.
Petitioner appeared personally and by and througb her attorney,Daniel J.Steinhagen.The
above named conservatee appeared personally. Also present was Kim DeBaere,Trust Officer with
U.S.Bank National Association,the proposed successor conservator of the estate.
The Court having considered the evidence and being fully advised in the premises now makes
the following:� '
' � FINDINGS OP FACT
L The conservatee appeazed personally at the hearing.
2. The conservatee continues to suffer from a severe brain injury as a result of an
industrial accident in 1999. The conservatee has significant deficits to his memory,
reasoning,judgment,communicative and cognitive abilities.He���as determined to be
in need of a conservator by order dated May 20, 1999, and remains in need of a
conservator.Mary L.Roberts,the conservator appointed by this Cow-t on May 20,
1999,now requests a financial institution be appointed as conservator of the estate of
the conservatee to assist her with a large pending personal injury settlement which
needs to be managed on behalf of the conservatee. U.S.Bank National Association is
a suitable and competent institution to serve as successor conservator of the estate and
is willing to serve.
3. The conservatee lacks sufficient understanding or capacity to make or communicate
responsible decisions concerning his estate or financial decis�

4. The conservatee has demonstrated behavioral deficits evidencing inability to manage
his estate.
5. The conservatee has properry which will be dissipated without proper management, and
funds are needed for the caze, support, and welfare of the conservatee.
6. No appropriate alternative to conservatorship exists which is less restrictive of the
conservatee's civil rights and liberties, including a protective arrangement under M.S.
525.54 Subd. 7.
7. The conservatee is incapable of exercising the following rights and powers:
a. To pay reasonable chazges for the support,maintenance and education of himself.
b. To pay his debts.
c. To possess and manage his estate, collect all debts and claims in his favor or
compromise them, to invest all funds not needed for current debts and charges,
management of the estate, and to represent himself in court proceedings or
institute suit.
d. To manage real estate.
8. iThe conservatee is not a patient in a State Hospital for the mentally ill or a mentally
retarded or dependent or neglected wazd of the Commissioner of Human Services or
under the temporary custody of the Commissioner of Human Services.
9. The conservatee is in need of a successor conservator of the estate to protect the
conservatee's estate, and is still in need of an ongoing conservator of his person.
10. U.S. Bank National Association is the most suitable and best qualified among those
available and willing to discharge the trust.
CONCLUSIONS OF LAW
1. Gary� Forde is an incapacitated person.
2. Mary L. Roberts requested the appointment of a successor conservator of the estate
of conservatee.
3. A successor conservator of the estate of Gary Forde should be appointed.

Now therefore,IT IS ORDERED:
1. That the petition be granted.
2. That U.S.Bank National Association be and hereby is appointed successor conservator
of the estate of conservatee.
3. That letters of successor conservatorship of the estate issue to U.S.Bank National
Association upon the filing of an acceptance, and that amended letters of
conservatorship of the person issue to Mary L.Roberts.
4. That the successor conservator have the power and duty to:
a. Pay the reasonable charges for the support,maintenance,and education of the
conservatee in a manner suitable to the conservatee's station in life and the value
of the conservatee's estate.
b. Pay out of the conservatee's estate all just and lawful debts of the conservatee.
c. Possess and manage the estate, collect all debts and claims in favor of the
conservatee,or with the approval of the Court,compromise them,institute suit
on behalf of the conservatee and represent the conservatee in Court proceedings,
- �_ and invest pursuant to Minn.Stat.§48.84 and Minn.Stat.§501.125 Subd. 1,all
_ funds not currently needed for debts and charges and management of the estate.
d. Manage real estate with authority to mortgage or sell upon further order of this
Court.
5. That the conservator shall give notice as provided in Minn.Stat.§525.56,Subd.3(3)
prior to any sale or disposition of conservatee's clothing,fumiture,vehicles,or other
personal effects.
6. That the conservatee retains the right to vote.
