Sanders' Subject: RE: Land Use Permit #04-1639, Dated November 8,2004, Leslie Miller Mr. Sanders: You are correct, LUP #04-636 was issued by Cindy Yackley, Deputy Zoning Administrator on November 8, 2004. I have discussed this with Cindy to determine the procedure that she used for issuing this permit. Cindy reviewed the FEMA Flood Insurance Rate Map (FIRM Panel 550591 0150) to determine the "Zone A" shaded area for these lots. She determined from the map and the building setback that the building site would not be in the "Zone A" area. I have also reviewed the map and I agree with her interpretation of the map. Therefore, using the map as a determination for potential flooding, there would be no reason why the permit should not have been issued. The decision to require the establishment of the 1379.5' elevation on-site is a decision of the person reviewing the permit application. After reviewing the FIRM Cindy did not believe that it was necessary to have the elevation set on these lots. I believe that the FIRM supports her decision. You mention a review of the USGS maps. This office does not use USGS maps as a prerequisite for issuing permits. The issue of this permit was in accordance with the office's permit review procedures. The same standard was applied to the review of this permit application as for other applications for permits on other lake lots, regardless of the lake. If another permit application for a Moose Lake property were to be reviewed today, the same procedures would be followed (i.e., first review the appropriate FEMA FIRM for that parcel). There is no prohibition (conflict of interest) for a soil tester performing a soil test on his/her property. The conflict of interest would be if the soil tester was also in a position to review/approve that soil test (i.e., he/she were an employee in this office). When reviewing a permit application we review the respective deed to ensure that the permit applicant is an owner of the property. WD 383 page 18 indicates that Leslie Miller is the owner of the lots for which the permit was issued. I do not see how we would know if there were "clear title" issues with this or any other property. You asked a number of questions related to "building permits." Page 2 of 2 � This is the same information that Jeff Mulock,with Apex Surveying,has been putting on his surveys for Moose � Lake in recent years.Further,I was told that this information would be applied to Sanitary Permits as well. It now has been brought to my attention,that you issued a Land Use Permit for lots#14&#15 in Section 30,TWP 41 North,Range 5 West on November 8,2004(#04-1636);computer control#024541305203.A Sanitary Permit was issued during this same time frame as well. On November 19,2004,based on your LUP(#04-1636)and the SP,Mr.Steven Boss(715-634-7161)with Boss Inspection Inc,issued a Building Permit(#RL-04-71)for the construction of a dwelling on lots#14&#15 and I understand that construction is proceeding. Here are some of the problems: 1. How did you determine the elevations of lots#14&#15? Who did the elevation survey? 2. Based on the USGS Survey Maps and personal inspections over the past several decades,it is clear that the natural elevations of lots#14&#15 are in your flood plain. 3. Further,even with the addition of the entire illegal back fill,there is a real question as to whether your minimum building site elevation has been achieved.Only an elevation survey could determine this. 4. Are you setting a new standard for the construction of dwellings on lake front property at Moose Lake?Can back fill be used to establish minimum flood plain&building site elevations on lake front lots on Moose Lake7 5. If you allow this project to proceed,are you in fact setting a new standard by default7 6. I believe that there is also a conflict of interest regarding the soils investigation which the Sanitary Permit is based on.Leslie Miller and David A Sanders(soils investigator)are related to each other (brother-in-laws).There is also the question as to whether Davis A Sanders has,or thinks he has,an equity interest in the two lots in question. 7. Do we have a case here where the"alleged owner"is running his own soils investigation on illegally placed back fill7 I believe that all this should be clarifed as soon as possible so that other land owners have a standard to plan around. As a"side-bar",it is interesting to note that the person(s)that you issued a Land Use Permit to does not have title insurance on the properties.Further,after investigations through Quality Title Inc,in Hayward;there are real concerns as to whether they have clear title at all.It appears that these properties were acquired through some type of devious"Meets&Bounds"survey system which is not allowed under Sawyer County rules for lake front property.In addition,the documents are not properly notarized.There is a big dark cloud hanging over these transactions. I should also like to point out that a certified survey existed at the time the un-notarized"Meets&Bounds" document was prepared.Further,the"Meets&Bounds"document was prepared from a"real survey"run by Mr. Ladd D Gould on 11 March 1980;revised 4 November 1981.At the time Mr.Gould(License#S-1171)was working for Throwbridge Engineering 8 Surveying Inc located in Sawyer County. Mc Gould's work is reflected in the above CSM attachments. Basically,I never signed these deeds in front of a notary or anyone else for that matter.Further,I have never been in Hayward,Wisconsin on any December 6,in any year of my entire life. Can you get a Land Use Permit on property that you don't have clear title to7 Can you get a Sanitary Permit the same way?Like wise,can you get a Building Permit?
