A part of this inspection was the determination of an"average lake setback." It is possible that you have already taken advantage of that visit by submitting an Application for Land Use Permit to this office. However, you should realize that a recent amendment to the Sawyer County Zoning Ordinance may prevent you from proceeding with your plans. This amendment shall take effect on Monday, January 5, 2004. ' A significant part of the amendment deals with the expansion of nonconforming dwellings (i.e., dwellings located closer than 75' to a waterbody). The"old" ordinance utilized basically two criteria for expansion; (1)the value of the dwelling to be expanded —the cost of the addition(s) could not exceed 50% of current estimated fair-market value of the structure and (2)the "average setback"from the waterbody as determined by the setbacks of dwellings on adjacent properties. The "new"ordinance requires that the expansion of a nonconforming dwelling meet significantly different criteria. Two of these criteria are: (1) the dwelling's setback from a waterbody—(i.e., a dwelling located less than 40' to a waterbody may not be expanded; however, a dwelling located between 40' and 75' from a waterbody may possibly be expanded)and (2)the amount of expansion(size of the addition) is based on the dweliing's existing ar�a(square footage), nct the value of the dwel?ing. The Sawyer County Board of Supervisors has "grandfathered" until June 30, 2004 the results of"average lake setback"property inspections performed in 2003. Any Application for Land Use Permit for any construction activities based on a 2003 "average lake setback"property inspection must be in this office no later than June 30, 2004. Applications based on an"average lake setback"presented to this office on July 1 St or later will not be accepted. I recommend that you contact this office if you have questions on how the new ordinance will impact your property.Office hours are 8:00 A.M.to 4:00 P.M.,Monday through Friday.
