Orner 8880 Knollwood Drive Eden Prairie, MN 55347 Re: Parcel :2.4, S 18, T 40N, R 08W, Town of Bass Lake, #8667N Brossard Road: Property Inspection Dear Mr. Orner: The purpose of this letter is to summarize my conversation with you based on my visit with you on Tuesday, July 1, 2003 and to update you on what has transpired with your property since my visit. You are proposing to construct a replacement cabin, or possibly add on to the existing cabin, sometime within the next few years. However, there are a number of issues with your property that will need to be addressed prior to the issue of a permit to construct either a new cabin or to construct an addition onto the existing cabin. The issues that are of concern relate to the minimum setback requirements for the replacement cabin. The replacement dwelling shall be no closer than: ➢ 75' to the ordinary high-water mark of the lake. The cabin is presently 55' from the lake (41' to the lakeside deck). ➢ 30' from the centerline of the easement road. The cabin is presently 31' from the centerline of the road (17' to the lakeside deck). ➢ 40' from any wetland area. It is my opinion that there are definite wetland areas that would impact the construction of a new dwelling. ➢ 10'/30' from the side lot lines. A replacement dwelling shall be located no closer than 10' from one side lot line and no closer than 30' from the opposite side lot line. ➢ 40' from the rear lot line. The issues that are of concern that relate to the construction of an addition to the cabin are the same as stated above with the following exceptions. ➢ Average lake setback: As we discussed, during my visit I performed an average lake setback measurement for your cabin. The average lake setback was determined to be 66' from the ordinary high-water mark of the lake. This distance was flagged on each side of the cabin. Construction activities closer than 66' to the lake would require the prior approval of a variance by the Sawyer County Board of Appeals.75' to the ordinary high- water mark of the lake. - ➢ 50% Current Estimated Fair Market Value (50% CEFMV) rule. The 50% , CEFMV rule applies in this situation as the cabin is a nonconforming . � structure—it is closer than 75' to the lake, 40' to adjacent wetland areas and 40' to the centerline of the easement road. The "50% rule"restricts the cost of improvements/structural repairs to a nonconforming structure to no more than 50% of the CEFMV of the structure. Based on the Town of Bass Lake assessor's assessment of your cabin($16,900), the 50% CEFMV for the dwellin� is $9,850. Construction costs exceeding $9,850 would require the approval of a variance by the Sawyer County Board of Appeals. A primary concern of mine is the boundary of any wetland areas that may impact the construction of a new dwelling or the construction of an addition on to the existing dwelling. It is your responsibility as the property owner to have the wetland boundary delineated. I am enclosing a list of wetland delineators with this letter. On Monday, July 7th, I visited the property with Dave Kafura, DNR, Water Management Specialist, for the purpose of examining the wetland situation. The wetland delineation and the summary report were produced by Cooper Engineering. As I stated in my earlier e-mail message to you, I'm familiar with your property as Cooper Engineering had completed a wetland delineation report for a neighbor and representatives of Sawyer County Zoning, DNR and Corp of Engineers conducted an on-site inspection to review that report this summer. Bill Christman, Sawyer County Zoning Administrator, mentioned that we may see a report for another property and we conducted that site review at the same time. The DNR concurs with the wetland delineation report for your property and agree with the conclusions that Mr. Engelhardt has made in this report. Basically, the historic cabin is on a thumb of fill that is not regulated as wetland, but is surrounded on three sides by a wetland environment. The reason stated for the delineation is to determine options for cabin improvement(s). That is the jurisdiction of Sawyer County Zoning. Based on the cabin age and site, the DNR would not object to improvements through the appropriate county process, as long as the improvements do not increase the size of the cabin footprint. Site location maps are in Attachment l. The delineation was performed to determine if Mr. Orner would be able to make improvements to his existing cabin without encroaching upon current lakefront and wetland setbacks enforced by county ordinance. An on-site wetland delineation was conducted on October 6, 2003. The vegetation, soils, and hydrology were observed and recorded at three sample plots (T1/PA, T1/PB, and Tl/PC) and one soil probe station (SP-1) established along one transect extending northwest to southeast across the property to assist in determining the wetlandlnonwetland boundary. A site sketch and the locations of the sample plots are shown on the sketch in Attachment 2. Data gathered from the wetland delineation indicated that the majority of the subject property consists of primarily lowland hardwood forest wetland. A small portion of the property near the lake, along an ice ridge paralleling the lake, consists of an upland community. Wetland boundaries were marked in the field using pink stake flags with "wetland delineation" written on them. Field forms used to perform the wetland delineation are in Attachment 3. Photographs of the site are in Attachment 4. It is apparent that a majority of the property was wetland prior to development. The only areas of confirmed upland communities existing on the site are located between the access road and GrindsCone Lake on the southeast side of the property. A sand and gravel ice ridge parallels the lake for a considerable distance along the north side of Grindstone Lake. The road was likely constructed by leveling the top of the existing ice ridge to access the potential building lots. The existing cabin was constructed in the early ]940s and appears to have been built on a small pad of sandy clay that was placed prior to construction of the cabin in order to build a suitable base Mr. Bill Christman October 22, 2003 Page 2 for the structure. This sandy clay gradually thins toward the middle of the property as observed in the soil probe SP-1 and gradually transitions into the peat soils observed at sample point T1/PA. It is apparent that �11 material was brought in prior to construction of the cabin or a portion of the ice ridge was pushed back to construct the building pad, due to the presence of a relatively thick horizon of dark mucky soil over silty sand below a surface horizon of much lighter sandy clay. In addition, a small drainage ditch network extends from northeast to southwest through the central portion of the property and the neighboring properties. This ditch directs water from this lot and the adjoining lots and drains it to Grindstone Lake from a neighboring property. This ditch was most likely constructed during the initial development of these lakefront lots to divert water from the existing wetland. The relatively small portion of the property surrounding the cabin that was filled in the early 1940s, prior to development, was not marked as wetland. This area was disturbed more than sixty years ago prior to any current laws or ordinances controlling the placement of fill in jurisdictional wetlands. The presence of the fill material and the drainage ditch on the property have degraded the wetland functional values of this portion of the property to a level at which even restoration activities would be of minimal success. In addition, this area is relatively small and the delineated wetland edge is very close to the existing structure. The location of the wetland edge in relation to the exsiting structure will limit the extent of any new construction or improvements on the structure due to current Sawyer County setbacks from wetlands and lakes.
