SHORELAND PRESERVATION AGREEMENT
(Shoreline Vegetation Protection Area)

WHEREAS, (list all owners) Leonard and Sandra Chlopek

owns real estate within Sawyer County that is subject to the Sawyer County Shoreland Regulations, and
WHEREAS, in order to secure a Land Use Permit.
� NOW, THEREFORE, the owner(s) hereby certifies that, as a condition of issue of said Land Use Permit, that
� the SHORELINE VEGETATION PROTECTION AREA on said real estate is intact to a minimum depth of
�. 35' landward from the ordinary high-water mark of the waterbody.
� The owner(s) hereby agrees to comply with the shoreland vegetative protection area requirements of Section
4.410 SHORELAND VEGETATION PROTECTION AREA, Sawyer County Zoning Ordinance, in effect on
ethe date that the land use permit is issued by the zoning office. The owner(s) further agrees to allow authorized
� representatives of the Governmental Unit to enter onto the owner's property at the following description
1between the hours of 8:00 A.M. and 6:00 P.M. [Section 9.13(1) POWERS, Sawyer County Zoning Ordinance]
� to inspect the structure(s) or uses authorized by said Land Use Permit and to determine if the SHORELINE
� VEGETATION PROTECTION AREA exists and that it is being preserved. This authorization shall terminate
� on the date of expiration of the land use permit. However, the owner's obligation to maintain the SHORELINE
� VEGETATION PROTECTION AREA in accordance with Section 4.410 SHORELAND VEGETATION
v PROTECTION AREA, Sawyer County Zoning Ordinance remains in effect. Violation of this Agreement will
authorize, in addition to other penalties and relief required under the Sawyer County Zoning Ordinance,
� injunctive relief, restoration of said real estate, the revocation of said Land Use Permit and the removal of all
structures approved by the issue of said Land Use Permit and the revocation of any other uses approved by the
� issue of said Land Use Permit. All parties agree that this Agreement shall be filed with the Sawyer County
� Zoning Office.

Dear Deb,
I have reviewed the building permit application for Leonard and Sandra Chlopek to construct an addition
onto their house on property described as unit 7 of Fawn Cove Condos. The property is further identified
as being in the SEiia of the NEtia of section 14, and in the SW'/a of the NWl/a of section 13 Town 40N,
Range 7W, in the Town of Hunter, Sawyer County Wisconsin, and has been assigned i.d.# 012-222-00-
0700 parcel—4.7.
The portion of their property that is in section 13 is located within a 100 foot Buffer Zone area as
measured from the 1313 msl. contour and would be subject to the restrictions therein. As such, no
structures are allowed within the 100 foot buffer and there are limitations on vegetation cutting and rock
placement. Additional restrictions extend 1,000 feet landward from the 1313 line which require that the
exterior color of the building be natural wood and earth tone color, and less than 35 feet in height.
It appears from their application plan that the proposed construction is in section 14, and as such lies
outside of the restricted area. The Chlopeks are allowed to continue with their building project so long as
construction remains in compliance with the Chippewa Flowage covenant restrictions specified in the
property deed.
