I. Future purchasers of the property subject to this agreement are obligated to ensure that the seller of the property has not violated the tecros of this ageement. Futwe property owners may be held liable for violations of this agreement. 2. The shoreline protection azea includes boih�isting and restored vegetation and erosion control practices. 3. The shoreline protection area shall have a minimum depth landward from the ordivary lugh- water mark of 35 feet. 4. For vegetation restoration, at least 70%of the shoreline, as measured parallel to the ordinary high-water mark, must be restored. Restoration may include a combination of eacisting and restored vegetation. 5. Vegetative protection,within the restoration area, shall provide a dense, complete and vigorous cover of vegetation consisting only of native grasses, groundcovers,uees, shrubs and wetland plants. 6. Adequate erosion control measures must be installed and maintained until the site is stabilized. 7. If soil tests indicate adequate nutrients, no fertilizers shall be added. Fertilizers,when requued by a soil test, shall be placed carefully for each pianting hole. The broadcasting of fertilizers shall be permitted onty in conjunction with a maintenance plan approved by the Sawyer County Land and Water Conservation Department. 8. Equipment storage(i.e.,velilcles, boau, docks, ete.) shall be excluded from the restaration area to prevent soil compaction and damage to the restored area. 9. The shoreline vegetative protection azea and erosion control practices shall remain in perpetuiry. 10. The fiill amount of all cost share payments paid out by Sawyer County and any other Federal, State or County agency shall be repaid if any term of this Agreement is not ful£dled, including: a. Failure to install, operate or maintain the shoreline vegetative protection area and erosion control practices. b. The removal of vegetative growth within the shoreline protection area. The Sawyer County Land and Water Conservation Department must approve the removal of any gasses, groundcovers,trees, shrubs and wetland plants from the shoreline protection azea. c. Adopting or changing any land use practice or management that defeats the purpose of the shoreline protection area. d. Changing land use or management on the entire which may cause sources of pollution wtuch were inadequately managed at the time flus agreement was signed to produce an increased pollutant loading to surface water or ground water. If such change in land management occurs, the properiy owner shall eontrol the sowce of pollution at his own expense or rehu�n the full amount of all cost sbare payments. e. Repayment of cost share payments is not requued if Sawyer County determines that a restoration area or erosion contro]practice is rendered ineffective due to circumstances beyond the cost s6are recipient's eontrol. 11. This Agreement may be amended by mutual ageement. 12. Tlvs Agreement shall be binding upon all parties hereto and[heir respective heirs, executors, administrators, successors, and assigns. 13. Invalidation of any part of the Agreement by a court of law shall not invalidate the remaining portions thereof.
