WHEREAS,in order to secure a Land Use Permit.
NOW,THEREFORE,the owner(s)hereby certifies that,as a condition of issue of said Land Use Permit,that
the SHORELINE VEGETATION PROTECTION AREA on said real estate is intact to a minimum depth of
35'landwazd from the ordinary high-water mark of the waterbody.
The owner(s)hereby agrees to comply with the shoreland vegetative protection azea requirements of Section
4.410 SHORELAND VEGETATION PROTECTION AREA,Sawyer County Zoning Ordinance,in effect on

On June 18, 2004, the Sawyer County Zoning Committee approved your application for a
special use on the following described real estate to wit:
The SW '/4 NW 1/4, S 16, T 37N, R 9W, Parcel .7.3. Parcel size is
10.76 acres. Property is zoned F-l . Permit is desired for a year-
round dwelling.
Findings of Fact of the Zoning Committee: It would not be damaging to the rights of
others or property values.
The permit can be issued when all other requirements have been met. Construction shall

Re:Application for Special Use Permit,Owner-Dale Swan:Wetland Setback
Encroachment Violation?
Yesterday,Wednesday,June 16,2004 I visited the Swan property to verify a caller's
concerns that the foundation is already in and that it is also located too close to a wetland
area. The foundation is in place and it is also my determination,based on soil probing,
vegetation and wetland water elevation that the foundation is located closer than 75'to a
wetland area(possibly as close as 61')adjacent to navigable water(a creek). I have
requested that Dave Kafura,DNR Water Management Specialist,accompany me to the
site to verify my findings.
Recommendation. If the Zoaing Committee wants to give tentative approval,the office
would not actually issue the permit until all minimum setback requirements are met. If it
is determined that a setback violation exists,a citation($335.00)would be issued with a
request to the Court that the foundation be made conforming.
