SHORELAND PRESERVATION AGREEMENT

WHEREAS, (list all owners) Bruce and Audrey Yunter

owns real estate within Sawyer County that is subject to the Sawyer County Shoreland Regulations, and
WHEREAS, in order to secure a Land Use Permit.
` NOW, THEREFORE, the owner(s) hereby certifies that, as a condition of issue of said Land Use Permit, that
� the SHORELINE VEGETATION PROTECTION AREA on said real estate is intact to a minimum depth of
35' landwazd from the ordinary high-water mazk of the waterbody.

� The owner(s) hereby agrees to comply with the shoreland vegetative protection azea requirements of Section
�j' 4.410 SHORELAND VEGETATION PROTECTION AREA, Sawyer County Zoning Ordinance, in effect on
L the date that the land use permit is issued by the zoning office. The owner(s) further agrees to allow authorized
� representatives of the Govemmental Unit to enter onto the owner's property at the following description
� between the hours of 8:00 A.M. and 6:00 P.M. [Section 9.13(1) POWERS, Sawyer County Zoning Ordinance]

� VEGETATION PROTECTION AREA exists and that it is being preserved. This authorization shall terminate
��on the date of expiration of the land use permit. However, the owner's obligation to maintain the SHORELINE
VEGETATION PR01'ECTION AREA in accordance with Section 4.410 SHORELAND VEGETATION
PROTECTION AREA, Sawyer County Zoning Ordinance remains in effect. Violation of this Agreement will
� authorize, in addition to other penalties and relief required under the Sawyer CounTy Zoning Ordinance,
9 mjunctive relief, restoration of said real estate, the revocation of said Land Use Permit and the removal of all
, structures approved by the issue of said Land Use Permit and the revocation of any other uses approved by the

Dear Mr. Yunker,
On October 19, 2004, the Sawyer County Board of Appeals approved as amended your applica-
tion for variance on the following described real estate to wit:
Part of Govt Lot 3, S 12, T 40N, R 9W, Parcel :3.5. Vo1306 Records Page 240. 1 .1 acres.
Property is zoned Residential/Recreational One. Application is for the construction of a
20'x24' (22'x26' with eaves) 1 %z story garage with loft storage area at a setback distance
of 52'/65' from the centerline of County Hwy. E. Variance is requested as Section
4.21(2), Sawyer County Zoning Ordinance, would require a minimum setback distance of
75' from the centerline of this highway. The Town Board has approved the application.
The Sawyer County Board of Appeals approved the application as follows: Allow 20'x26'
(22'x28' with eaves); with removal of old storage shed; one year time limit.
Findings of Fact and Conclusions of Law of the Board of Appeals: Hardship is present because
of the uniqueness of the property and because applicant lives here year round. It is not contrary to
the public interest. It would not be the convenience of the owner. It would not be the basis of
economic gain or loss. It would not be a self-created hardship.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the f this notice. In future correspondence, or in applying for permits, please
refer to Varian e 04-024. '
