Re: Unit#2, Little Bit of Heaven Condominium: Application for Variance
Dear Mr. Moelter:
I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance - Additional Information,"
• a copy of the Sawyer County Board of Appeals Conclusions of Law Form (This is the
form that the Board members will use to determine if your situation meets the
requirements for the granting of the variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
application for correctness. If correct, sign the application and return it to this office with
a check in the amount of$250.00 made out to the "Sawyer County Zoning
Administration"by Friday, February 6, 2004 for hearings in March 2004.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
The "Variance Application"will be reviewed at two public hearings. The first hearing
will held by the Town of Bass Lake at 6:30 P.M., Monday, March 8, 2004. You should
contact Shirley A. Miller, Town of Bass Lake Clerk, at (715) 634-8469 (Town Hall) to
confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, March 16, 2004 in the large courtroom located in the Sawyer County
Courthouse. You or your agent should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Bass Lake is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that has �
been requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present the facts to the
Board.
At its October 2002 public hearing, the Board members decided to apply expiration dates
to future variances. You should be prepared to discuss this issue with the Board (i.e.,
proposed date that construction would begin, any anticipated construction delays that may
be caused by the availability of contractors, excavators etc.).
I believe that there are three issues that effect this application. One of them is the 100-
year flood elevation and the other two (mitigation and impervious surfaces) are based on
the new shoreland zoning ordinance that became effective last month.
• 100-year flood elevation. You aware that a land use permit will not be
issued until the DNR has approved a 100-year flood elevation for the lake.
You should request that the Board start the "two-year clock"when the
DNR has approved the 100-year flood elevation for the lake.
• Miti�ation—Restoration of the shoreline vegetation protection area.
(Section 4.419 MITIGATION REQUIREMENTS). The shoreline
vegetation protection area is that strip of land 35' deep that parallels the
shoreline. This "strip" is to be maintained in its native vegetative state
with the exception of corridors that may be cleared for access to the lake.
It is my observation that there is little, if any, vegetation within 35' of the
lake.
In your situation, no intact shoreline vegetative protection area, a
"Mitigation/Restoration Plan"must be approved by this office prior to the
issue of any land use permit. Mitigation could take place while we are
waiting for the 100-year flood elevation.
• Impervious surfaces (Section 4.422, IMPERVIOUS SURFACE
LIMITATIONS). The maximum total area of impervious surfaces shall
not exceed fifteen percent(15%) of a total shoreland lot area within 300'
of the ordinary high-water mark. This amount may be increased to 25%
with the approval of a conditional use permit by the Sawyer County
Zoning Committee.
The entire condominium area is less that 300' in depth from the lake. The
total land area is 0.9377 acres (40,846 square feet) with an allowable
impervious surface area of(40,846 square feet x 15% = 6,127 square feet).
Presently, based on the condominium plat and the footprints of the
existing buildings, there appears to be approximately 6,000 square feet of
impervious surface. This amounts to 14.7% of the total land area of the
condominium. Unit#2 appears to have an approximately 942 square feet
footprint (does not include eaves). The proposed replacement dwelling
has a footprint area(including eaves) of 1680 square feet, or 738 square
feet larger than unit#2. This additional square footage would amount to a
total impervious surface area of 6,900 square feet, which would be greater
than the allowable 15%or 6,127 square feet. Even if the Board of Appeals �
were to approve construction of the dwelling as you have proposed,a �
conditional use permiY would still be required to be approved by the
Zoning Committee.
Since footprint size is the issue,you might want to consider decreasing the
proposed dwelling's footprint and go to a full second story to give you the
enclosed habitable living area that you desire.
