Setback: Within Reservation boundaries: Restrictions and other information: w �_ . w w � 4.49 SETBACKS FROM NAVIGABLE WATER A 1) For lots that abut on navigabie waters, all buildings and structures, new dweliings on � vacant lots and replacement dwellings; except piers, boats hoists, boathouses, and open fences which may require a lesser setback, shall be set back a minimum of 75 l► feet from the ordinary highwater mark of navigable waters and wetlands adjacent to any � navigable water. All setback distances are measured from the overhang or appendage � such as a deck, horizontally to the closest point of the ordinary highwater mark, For lots that abut on nonnavigable wetlands, all buildings and structures shall be set back a S minimum of 40 feet from the wetland boundary. Navigable wetlands shall be � determined by the zoning administrator. e 2) Reduced building setbacks. For additions to existing structures, a waterline setback � of less than that required by Section 4.49 (1), may be permitted by the Zoning S Administrator where there is at least one principal building on either side of the � applicanYs lot, within 200 feet of the proposed site that is built to less than the required , setback. The setback shall be the average of the setbacks of existing principal buildings and the required setback on vacant lots. On undeveloped property within 200 feet, each minimum lot width shall be deemed a vacant building site and shall be calculated with the required 75 foot � setback. 1 ( 3) Boathouses shall be set back at least twenty (20) feet from the ordinary highwater mark. A boathouse shall be designed; constructed and used solely for the storage of � watercraft and related equipment. Gazebos, screened buildings or similar structures � shall not substitute as boathouses. Structures designated as boathouses shall not � impart the impression that they are/will be used as anything other than boathouses. � Only one (1) boathouse shall be constructed on a waterfront property. A boathouse shall not exceed 250 square feet in floor area and ten (10) feet average grade vertical I measurement. A boathouse roof shall be pitched or gabled with a minimum of 1:12 pitch. It shall not be equipped with railings or stairs or be used as a deck. The use of a boathouse for human habitation is prohibited. A boathouse shall not be constructed where the existing slope is more than 20 percent. A boathouse shall not be visually intrusive. 4) Stainvays and walkways may be constructed within 75 feet of the ordinary highwater mark providing: (a) Stairs and walkways shall not exceed four (4) feet in width. (b) Stairs and walkways shall be located so as to minimize eaRh disturbing activities and shoreline vegetation during construction. Stairs and walkways shall be supported on piles or footings and shall not be excavated from erodibie soils, steep slopes or a bluff face. I signed the application as the issuing agent;however,the permit was issued due to my enor. The Sawyer County Zoning Ordinance contains specific location and dimensional requirements for the construction of a boathouse. These requirements are that the boathouse shall: 1. Be located no closer than 20'to the ordinary high-water mark of the lake. 2. Not exceed 250 square feet in area. 3. Not exceed 10 feet in height above average grade. 4. Have pitched or gabled roof with a minimum 1:12 pitch. Your boathouse has a height greater than 10'and the application clearly states that the boathouse will be 16'in height to the peak. Therefore,the permit as issued is in violation of the Sawyer County Zoning Ordinance. The boathouse cannot be allowed to be constructed in violation of the ordinance. I discussed this matter with the Sawyer County Zoning Committee at today's public heazing. I informed the Committee that,even though the error in issuing the permit was mine,I still have no choice but to ensure that the boathouse is constructed in accordance with ordinance requirements. I also told the Committee that I would be writing a letter to you requiring that the boathouse height be reduced to no greater than 10'by June 1,2004. I apologize for the inconvenience and hardship that this will cause you. Please contact this office if you have any questions or comments.
