Both applications indicated that each sign would be located off of the highway right-of- way (50' from the highway centerline). One of the signs has been erected (#04-013). Earlier this week this office received an inquiry about that sign - its size and location with respect to the roadway. Upon investigation Eric determined that, while the sign "post" was 50' from the centerline, the cross-member was only 45' from the highway centerline. It was after reviewing the permits that it was realized that the ordinance allows only one such sign on this roadway. Eric wrote a letter to the church explaining the situation. Today three members of the church came to the office to discuss this matter — the pastor, Sherry Burdette, Church Clerk and another church member. After explaining setback requirements (setbacks are measured to the closest point of the structure — the cross-member and that the ordinance permits only two such signs adjacent to this highway) the following compromise was reached. • A refund would be made to the church for the second sign permit (#04- 012). The sign has been constructed but not erected. Rational — the ordinance provides for only a single sign. • The existing sign will be allowed to remain in place (encroaching by five feet to the cross-member). Rational — the sign post is set in 300 pounds of concrete. The church members were informed that if the DOT should raise an issue or if this office received criticism about the encroachment, that the sign would have to be made conforming. �2���z�.�•� �-G ' aj� William A.
