Re: Building/Structure Moved On and Sign Erected Without Permits
Dear Mr. Penman:
As I believe you are aware, this office received inquiries about the chainsaw carving
business on your property, the building that the business operates from and the "Lenroot
Lodge" sign adjacent to State Highway 63.
Chainsaw carving business: I have been asked if this business is appropriate in the
Commercial one (G 1) zone district My interpretation of the zoning ordinance is that
this is a permitted business in that zone district. I have also been asked if a permit was
issued for moving this building to its current location. The ordinance requires that a land
use permit be issued for the placement of, or the construction of, a structure exceeding
100-square feet. I have enclosed a fee schedule and an application for land use permit for
this building. Since this building is being used for commercial purposes (selling
products), it qualifies as a"new commercial building" for fee purposes. Additionally, a
double permit fee is required since the building was constructed/moved on prior to the
issue of a permit.
Stora�e structure: This is the same structure that we discussed a couple of years ago. I
believe that this building was used at one time for the sale of plants and other items but
now appears to be used for storage. My interpretation of the ordinance is that this is an
accessory structure that is being used to support other activities on the property. A
permit is required for this structure; however, since we previously discussed this situation
I do not believe that a double permit fee is appropriate. You can add this structure to the
same permit for the building above.
"Lenroot Lod e'g ' si�n: This office has no record of issuing a permit for the placement of
this sign. I have also enclosed a sign permit application for the sign. A double permit fee
of$50.00 will apply since the sign was erected without a permit.
Gary, if you disagree with my interpretation of the ordinance, I will place this as an �.
agenda item for the Zoning Committee to discuss at its Friday, June 20, 2008 public
hearing. If you agree with my interpretation, please return the completed applications - -
with fees to this office by Friday, June 13, 2008.
