Re: Expiration of Special Use Permit (SP) #08-226 —Dwelling not Constructed
Dear Mr. Heinzeroth:
It has been brought to my attention that SP #08-226 expired on July 31, 2009. This
permit was issued for the construction of a dwelling with attached garage and shop.
Apparently only the shop has been constructed.
Section 4.26, Sawyer County Zoning Ordinance states in part:
4.26 ACCESSORY USES AND STRUCTURES
1) Any permanent, roofed structure serving as an accessory use if attached to the
principal building, shall be considered a part of the principal building. If such structure is
a building and is not attached to the principal building, it shall conform to the setback and
other dimensional requirements of the district within which it is located. The construction
of accessory buildin�s on vacant property is prohibited.
Unless a dwelling is constructed on your property, the fact that now only an accessory
building exists on the property creates a violation of the Sawyer County Zoning
Ordinance.
At this point I am able to provide a six month extension of your permit (January 3 l,
2010) in hopes that you will be able to complete construction of the dwelling by that time.
If you are unable to complete construction of the dwelling with the current permit you
must apply for another permit for the construction of the dwelling. The new permit could
be issued by this office rather than having to submit it to the Town of Sand Lake Town
Board and the Sawyer County Zoning Committee for approval. Unfortunately the other
option is to make arrangements to remove the accessory building from the property.
