� WHEREAS, in order to secure a Land Use Permit.

� NOW, THEREFORE, the owner(s) hereby certifies that, as a condition of issue of said Land Use Permit, that
� the SHORELINE VEGETATION PROTECTION AREA on said real estate is intact to a minimum depth of
��y 35' landwazd from the ordinary high-water mark of the waterbody.
� The owner(s) hereby agrees to comply with the shoreland vegetative protection area requirements of Section
� 4.410 SHORELAND VEGETATION PROTECTION AREA, Sawyer County Zoning Ordinance, in effect on
� the date that the land use permit is issued by the zoning office. The owner(s) further agrees to allow authorized
representatives of the Govemmental Unit to enter onto the owner's property at the following description
S between the hours of 8:00 A.M. and 6:00 P.M. [Section 9.13(1) POWERS, Sawyer County Zoning Ordinance]
� to inspect the structure(s) or uses authorized by said Land Use Permit and to determine if the SHORELINE
� VEGETATION PROTECTION AREA exists and that it is being preserved. This authorization shall terminate
� on the date of expiration of the land use permit. However, the owner's obligation to maintain the SHORELINE
� VEGETATION PROTECTION AREA in accordance wich Section 4.410 SHORELAND VEGETATION
PROTECTION AREA, Sawyer County Zoning Ordinance remains in effect. Violation of this Agreement will
� authorize, in addition to other penalties and relief required under the Sawyer County Zoning Ordinance,
�injunctive relief, restoration of said real estate, the revocation of said Land Use Permit and the removal of all

Dear Mr. Van Vonderen:
On January 8, 2008, Ms. Ann Michalski, PSS, PWS, CST, WDNR Professionaliy Assured Wetland Delineator, of
Northern Environmental Technologies, Incorporated (Northern Environmental) visited proper[y located on Mirror
Lake at 11559N Eagle Lane in the Town of Round Lake, Sawyer County, Wisconsin (the Property). The Property
location and local topography is shown on Figure l. Per your request, Ms. Michalski conducted a property review
to identify the wetland and ordinary high water mark (OHWM) locations for purposes of determining building
setbacks. Although these type of determinations are typically conducted during the growing season, you requested
that Ms. Michalski examine the site to avoid costly delays with the understanding that snow cover might hinder
observations.
Despite snow cover at the site, vegetation was easily observed in both the uplands and wetlands and soil pits were
easily advanced to observe soils and hydrology. The wetland areas observed are primarily dominated by
Chamaedaphne calyculata (Leatherlea�, Spiraea alba (Meadowsweet), Rubus strigosus (Red Raspberry) in the
herbaceous layer, Alnus rugosa (Speckled Alder) in the shrub layer, and Pinus strobus (White Pine) in the tree layer.
Areas identified as uplands on this Property are primarily dominated by Pteridium aqualinum (Bracken Fern) and
Corylus cornuta (Beaked Hazelnut) in the herbaceous layer, Corylus cornuta (Beaked Hazeinut) in the shrub layer,
and Pinus strobus (Eastern White Pine), Quercus rubra (Northern Red Oak), and Acer rubrum (Red Maple) in the
tree layer. Soils in the wetland area consisted of peat overlying muck soils with saturation at approximately 6 inches
below the soil surface and standing water at approximately 14 inches below the soil surface. Upland soils consisted
primarily of brown sandy loam soils lacking any redoximorphic features. Based on observations of vegetation,
hydrology (or lack o�, soils and topography at the Property, the wetiand boundary was flagged with pink ribbon
labeled "Wetland Delineation." The Property layout, wetland boundaries, and topographical contours are indicated
on Figure 2.
The site visit also consisted of identifying the OHWM at the site. The OHWM was staked based on observations of
vegetation such as white pine and speckled alder growing along the shoreline, as well as what appears to be
shoreline erosion or destruction of the shoreline due to wave action. A survey of the site indicates that the lake level
is at an eleva[ion of 94.49' and the edge of the wetland ranges from 96.0' to 98.0.' Based on survey information
available and observations at the site, the OHWM was identified and flagged with pink stakes labeled "Wedand
Delineation." Photos of the OHWM/Wetland boundary are attached.
Activities such as dredging, filling, grading, etc. of wetlands are regulated at several levels of governmen[ and would
require permits prior to any such activities. Land disturbance on the banks of a waterway also often times requires
permitting. Please contact Northern Environmen[al, WDNR, or ACOE regarding permitting issues.
