The submittal has been CONDITIONALLY APPROVED. This system is to be constructed and located in accordance with the enclosed approved plans and with any component manual(s) referenced above. The owner, as defined in chapter 101.01(10), Wisconsin Statutes, is responsible for compliance with all code requirements. No person may engage in or work at plumbing in the state unless licensed to do so by the Department per s.145.06, stats. The following conditions shall be met during construction or installation and prior to occupancy or use: • A sanitary permit must be obtained from the county where this project is located in accordance with the requirements of Sec. 145.135 and 145.19, Wis. Stats. • The application for a sanitary permit shall be accompanied with documentation that indicates the installer of the White Kniaht WK-200 units has comoleted aporoved traininq or that a�oroved trainina will be provided bv a manufacturers' representative durinq the installation of the POWTS, (per SPS 383.21(2)(c14. Wis. Adm. Code). • The application for sanitary permit shall be accompanied with leqal documentation that shows that all of the comoonents requirinq servicinq at an interval of 12 months or less have been recorded on the deed for the propertv. (Per SPS 383.2112)(c)5. Wis. Adm. Code). • inspection of the private sewage system installation is required. Arrangements for inspection shall be made with the designated county official in accordance with the provisions of Sec. 145.20(2)(d),Wis. Stats. • The existing POWTS shall be properly abandoned per SPS 383.33,WAC. • A copy of the approved plans, specifications and this letter shall be on-site during construction and open to inspection by authorized representatives of the Department, which may include local inspectors. Owner Responsibilities • The current owner, and each subsequent owner, shall receive a copy of this letter including instructions relating to proper use and maintenance of the system. Owners shall receive a copy of the appropriate operation and maintenance manual and/or owner's manual for the POWTS described in this approval. . The owner of the POWTS shall be responsible for ensuring that the operation and maintenance occurs in accordance with this chapter and the approved management plan under SPS 383.54(1). • In the event this soil absorption system or any of its component parts malfunctions so as to create a health hazard, the property owner must follow the contingency plan as described in the approved plans. In granting this approval the Division of Industry Services reserves the right to require changes or additions should conditions arise making them necessary for code compliance. As per state stats 101.12(2), nothing in this review shall relieve the designer of the responsibiliry for designing a safe building, structure, or component. The term of this Agreement shall commence on Effective Date(date�,and continue in full force and effect for a period of 1 year(the"Initial Term"). b. The Agreement shall renew automatically upon Companys receipt of service subscription renewal payment for successive 1-year periods without further action by the parties("Renewal Term"),uniess either party sends written notice to the other party not less than 30 days prior to the expiration of the Initial Term or any Renewal Term. c. The"Compan�'may also terminate this Agreement,upon 30 days notice to the"Customer,"for any of the following reasons. The Customer recognizes and agrees that any third party has no right or obligation to rely upon the services performed by the Company pursuant to this Agreement. The"Customer'agrees to have the"Compam/'provide the services as agreed upon and in conjunction with the Scope of Services: a. To have the system serviced on a regu�ar schedule, b. To perform all maintenance,repairs,replacementr,and, c. To obtain oiher services deemed necessary for the proper operation and management of the onsite wastewater treatment system. Specifcally,and without limitation,tfie"Customer'understands and agrees that the onsite was[ewater treatment system is designed and construc[ed to treat only a specified volume of water per day,and that an increase in the volume of water used by the system wn cause damage to or failure of the system. The"Customer"must operate and maintain the system in a manner consistent with the recommendations of the manufac[urer,the original designer/contrec[or,and/or the"Company,"induding not exceeding the design specifications of the sys[em as directed by these entities. This Agreement does not require the'Company,"to,and expressly exdudes any repair and/or replacement of any component part of the onsite wastewater treatment system that is under guarantee by the manufacturer. In the event the"Compan�/'identifies a defect or other problem in the onsite wastewater treatment system, or otherwise recommends the performance of repairs,maintenance or any other work associated with the onsite wastewater treatment system,the"Compan�'shall not be required to perform any such additional work,repair or maintenance unless,and untii a separate written agreement is prepared. The separate agreement wili identify the specific work tasks to be completed and additional compensation to be paid to the"Company,"and signed by authorized representatives of the"Customer'and the"Company."
