Notice is hereby given that on January 18, 2024 the Sawyer County Board of
Supervisors denied the Ratification of a change of zone district of the following
described real estate to Residential/Recreational One(RR-1).
Part of Government Lot 4;S2Q T38N,R09W,'Parcel#008-938-20-5402;Tax ID#9231;
18.90 total acres,Zoned Forestry One(F-1).Purpose of request is to rezone 4.70 acres
and then su6divide into 3 lots of the lakeshore parcel with 569 feet of shoreline on Little
Sissabagama Lake. The 3 lots will be approximate 287 feet of shoreline, 136 feet of
shoreline, 146 feet of shoreline. This 4.70 acre would be rezoned from Forestry One(F-
1J to Residential/Recreational One(RR-1)and the remaining 13.3 acres will stay
Forestry One(F-1). The S/W district overlay is not subject to change as part of this
request.
Any person orpersons jointly aggrieved by the decision of the County Board may
commence an action in the Circuit Court for Writ of Certiorari to review the legality of the
decision within 30 days after the date the decision was ratified by the County Board.

On December 15, 2023, the Sawyer County Zoning Committee denied your application
for a change of zone district on the following described real estate to wit:
Motion by Shuman to deny the application with findings of fact: 1) It would be
detrimental to ecology, wild life, wetlands or shorelands. 2J. It would create an air
quality, water supply, or pollution problem. 3). It would create topographica/problems
such as run off, drainage, erosion, flooding, or vegetative cover removal. Second by
Wilson. Discussion held. Roll call finds: Buckholtz—yes, Hessel—yes, Wilson —yes,
Shuman—yes, Righeimer— no. Four to One for denial of application.
The Sawyer County Board of Supervisors must ratify the denial of the change in zone
district before it becomes final. This will be scheduled for the County Board meeting on
January 18, 2024 at 6:30 P.M., in the Circuit Courtroom of the Sawyer County
Courthouse.
This decision is a recommendation to the County Board of Supervisors. Any person(s)
jointly aggrieved by the decision of the County Board may commence an action in the
Circuit Courf for Writ of Certiorari to review the legality of the decision within 30 days

WHEREAS,Wisconsin law permits Sawyer County(the"County")to adopt certain
zoning ordinances and amend its existing zoning ordinances, including amendments to
the County's official zoning map;

Additional Actions. The Sawyer County Department of Zoning and Conservation
Administrator (or his/her designee) shall take all necessary steps to ensure that the
amendment adopted herein is completed.
This Resolution is recommended for adoption by the Sawyer County Board of
Supervisors at its meeting on January 18 2024 by this Sawyer County Zoning

Purpose of request is to rezone 4.7 acres of the F-1 underlaying zone district to
Residential/Recreational One (RR-1). The Shoreland-Wetland (S-W) is not to be affected by the
proposed rezone. The proposed rezone to Residential/Recreational One (RR-1 ) is requested in
order to divide the parcel into 3 new lake shore lots on Little Sissabagama Lake with the
proposed rezone to RR-1 and 1 new lot consisting of the remaining 14.2 acres of F-1 . This would
result in conforming zone district lot creations per dimensional requirements.
Summary of Request & Project History:
The applicant is requesting to rezone 4.7 acres of the above described property from F-1 to
RR-1 . The S/W District overlay is not part of the rezone request and would stay as an overlay. The
F-1 zone district requirements would need a minimum of 5 acres and a 300' width requirement.
Thus, the zone district change is being requested. With the proposed rezone the applicant would
then need to submit for a certified survey inap which as part of the preliminary map (attached)
would have 3 new lakeshore lots on Little Sissabagama and 1 remaining lot of approximately 14.2
acres which would stay F-1 . The lake shore lots would vary with meandering frontage but all to
be approxi�nately 133' in a right-angle width and over 483' of depth.
The Town of Edgewater comprehensive plan has 2 different versions of future land use
maps. The one version shows this area as "shoreland" or `'shoreland residential". Shareland as
defined by the Town of Edgewater comprehensive plan still references the old Lake Classification
system which is no long in effect. These Lake Classifications were initially intended to protect
environmental sensitive bodies of water. This property is located on Little Sissabagama and an
unnamed lake which were "Wilderness" bodies of water which prior to the 2017 Shoreland Zoning
Ordinance changes would have required a 300' wide lot of water frontage and a minimum land
area of 5 acres.
The Town Comp Plan has a further future land use-no buffer map which shows this area
as Forest Residential. Within the no-buffer map (Shoreland Protection Area Removed) the Town
identified this area as "forest residential". Forest residential as defined by the Town of Edgewater
Comp Plan further goes on to state that recominended density be 1 dwelling per 20,000 square feet
and within the County Zoning Ordinance three residential zoning categories are represented in the
town, R-1, RR-1, RR-2, all having the same development standards relating to dimensional
(density) requirements
The site conditions in this location will need additional grading permits to ensure erosion
control as proposed dwelling locations would be located on slopes in excess on 40% in some
locations.
This is the 2°d rezone request for the property. The previous request last year was to rezone
the entire 18.9 acres from F-1 to RR-1 with no future development plan. That previous request was
approved at the Town and Zoning Committee level but failed final ratification at County Board on
a super majority vote in that over 50% of the adjacent property owners filed a petition to protest
against the proposed rezone. The proposed rezone request is now only for the 4.7 acres and a
preliminary survey map has been subinitted.

Town Comments:
Lots of discussion regarding the Hathaway Lodge request to Rezone 3389N Green Lake Road from Forestry
One (F-1) to Zone District Residential/Recreational One (RR-1). Meg lattery and Brent Friendshuh spoke in
favor of this rezone request. Area residents spoke of their concerns regarding the potential negative impact on
Little Sissabagama Lake should these lots be developed into 3 parcels. The Board listened to valid points
raised by all and agreed that as property owners they have the right to request this rezone when other lots that
are now developed were also previously zoned F-1 The Board also understands that the area residents are
firmly in objection. Pete made a motion to approve with a 2- by Scott. This was followed by more discussion
and the final Board vote was 1 in favor and 2 opposed.

on December 15, 2023, and for the opportunity to provide comments. The following are general comments regarding
shoreland zoning as they relate to the requests. These comments relate to the requirements of the Sawyer County
Zoning Shoreland-Wetland Protection Ordinance.
Hathaway Lodge LLC/Steven Arnold Friendshuh Trust Rezone Request. Note that a rezone from F-1 to RR-1 does not
change the overlying shoreland-wetland district and associated requirements. The Surface Water Data Viewer indicates
mapped wetlands on portions of the property in question. The Surface Water Data Viewer also indicates wetland
indicator soils across much of the property. The department recommends ensuring any use associated with the
applicanYs request meet applicable shoreland-wetland requirements, including remaining outside any wetlands and not
creating discharge to any wetlands. Further,given Little Sissabagama Lake is the western border of the property the
department recommends informing the applicant that any use associated with the applicanYs request will also need to
meet applicable shoreland zoning requirements.
The department has no comments regarding any of the other requests.

Ok - I wAs close to the nnswer. Tniked to our attorney and he stnted it more clearly.
1. The Trust is the single sole owner of the Hnthaway Lodge, LLC and Mnrk and I are the
Trustees.
2. The ownership of the property remains the Hathnway Lodge, LLC.
3. Prior to Steve's pnssing he nssigned his ownership (he was 100% owner of Hnthnway
Lodge, LLC) to the trust (see nttached Assignment of Transferable Interest). Steve
remained the manager nnd made me the President of the Hnthaway Lodge, LLC (see
attached Amended and Restated Opernting Agreement nnd the Written Action).
Since Steve hns passed, we will need to update the Hathaway Lodge, LLC Operating Agreement
to reflect Mnrk as Mannger but thnt is not necessary for this proceeding. In the interim, the
Hathnway Lodge, LLC docs allow the president to act on the LLC's behalf.

We have been informed by the applicant that they are wishing to postpone their application until the October Public
Hearing Meeting.
With that being said however, the Town's opinion does greatly matter when deciding public hearing cases. I tried to
convey this to Mr. Baribeau earlier this week. We will be sending this back to the Town for their October Town Board
Meeting. The Town has an important role within this zoning process and I must insist that a recommendation for either
approval, denial, or table for additional information needs to be made. Use the "findings of facY' including within my
staff report as to support a decision but a decision must be made. These requirements are laid out in specific WI Case
Law and WI Statutes 59.69(5)(e). I can confirm with the County's legal counsel on this matter but a "no decision" vote
leads to a very sticky appeal process and a no decision vote from the Town will most likely result in a "table"from the
Sawyer County Zoning Committee until a time that The Town has made a decision.

Request:
Purpose of request is to rezone 4.7 acres of the F-1 underlaying zone district to
Residential/Recreational One (RR-1). The Shoreland-Wetland (S-W) is not to be affected by the
proposed rezone. The proposed rezone to Residential/Recreational One (RR-1 ) is requested in
order to divide the parcel into 3 new lake shore lots on Little Sissabagama Lake proposed rezone
to RR-1 and 1 new lot consisting of the remaining 14.2 acres of F-1 .
Summary of Request & Project History:
The applicant is requesting to rezone 4.7 acres of the above described property from F-1 to
RR-1 . The S/W District overlay is not part of the rezone request and would stay as an overlay. The
F-1 zone district requirements would need a minimum of 5 acres and a 300' width requirement.
Thus, the zone district change is being requested. With the proposed rezone the applicant would
then need to subinit for a certified survey inap which as part of the preliminary map (attached)
would have 3 new lakeshore lots on Little Sissabagaina and 1 re�naining lot of approximately 14.2
acres which would stay F-1 . The lake shore lots would vary with meandering frontage but all to
be approximately 133' in a right-angle width and over 483' of depth.
The Town of Edgewater comprehensive plan future land use shows this area as
"shoreland". Shoreland as defined by the Town of Edgewater comprehensive plan still references
the old Lake Classification system which is no long in effect. These Lake Classifications were
initially intended to protect environmental sensitive bodies of water. This property is located on
Little Sissabagama and an unnamed lake whicll were "Wilderness'' bodies of water which would
have required a 300' wide lot of water frontage and a �ninimum land area of 5 acres. The Town
Comp Plan references only up to the old Class 3 system which would have a minimum density of
1 home per 40,000 square feet of land area and 200' of frontage. The Town Plan further goes on
to state, "in some cases, natural features and resources along lakes, rivers, and streams may not be
conducive to all types of development. While the future land use map has areas representing the
1,000 foot and 300 foot areas pertaining to development requirements as specified by the lake
classification systein,the areas shown do not imply that any and all development types are allowed.
Specific review of the areas around lakes, rivers and streams must be perfonned.
If the property was rezoned to RR-1 the minimum lot sizes would be 100' of width of
frontage and 200' of depth under the new shoreland zoning rules. 4 lake share lots within this area
would be extremely difficult and not recominended for that type of condensed development. With
the proposed 3 lake shore lots there would be inore rooin as to ensure proper site stability. The
surrounding land area is mixed between F-1 and other RR-1 properties with single family dwelling
developinent along Little Sissabagama Lake.
This is the 2°a reaone request for the property. The previous request last year was to rezone
the entire 18.9 acres from F-1 to RR-1 with no future developinent plan. That previous request was
approved at the Town and Zoning Coinmittee level but failed final ratification at County Board on
a super majority vote in that over 50% of the adjacent property owners filed a petition to protest
against the proposed rezone.

NOTICE OF TOWN MEETINGS AND ZONING COMMITTEE PUBLIC HEARING DATE
CUP #23-005, Hathaway Lodge LLC/5. Frienndshuh
Your application for a Conditional Use will be considered at several different meetings.
You should first contact the Town Board for their review. Some Towns also have a
Planning Commission. Please contact the Town Clerk, Natalie Clemens at 715-354-
7747 or emaii at info@townofedgewater.com for the day and time of the Planning
Commission and Town Board meetings for your attendance or the attendance of your
agent.
The Sawyer County Zoning Committee will hold its Public Hearing on August 18, 2023.
This Hearing will begin at 8:30 A.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Town meetings
and Zoning Committee Public Hearing. Enclosed is virtual attendance information. A
lack of information about the application may result in an unnecessary delay of a
decision. Failure to appear may also result in the denial or tabling of the application
and may result in additiona� fees.
If it is impossible for you or a representative to be present, please submit a written
statement directed to Ronald Buckholtz, Chairman of the Zoning Committee addressed
to this office. The statement should include your proposed intentions or purpose of the
request and a description of the general terrain and surrounding development. Indicate
how the proposal would not be contrary to the public interest. Photographs of the
property and surrounding area are encouraged.
PLEASE NOTE:If approval is granted,a permit may be required. Land Use Applications
