The Town Comp Plan has a further future land use-no buffer map which shows this area as Forest Residential. Within the no-buffer map (Shoreland Protection Area Removed) the Town identified this area as "forest residential". Forest residential as defined by the Town of Edgewater Comp Plan further goes on to state that recominended density be 1 dwelling per 20,000 square feet and within the County Zoning Ordinance three residential zoning categories are represented in the town, R-1, RR-1, RR-2, all having the same development standards relating to dimensional (density) requirements The site conditions in this location will need additional grading permits to ensure erosion control as proposed dwelling locations would be located on slopes in excess on 40% in some locations. This is the 2°d rezone request for the property. The previous request last year was to rezone the entire 18.9 acres from F-1 to RR-1 with no future development plan. That previous request was approved at the Town and Zoning Committee level but failed final ratification at County Board on a super majority vote in that over 50% of the adjacent property owners filed a petition to protest against the proposed rezone. The proposed rezone request is now only for the 4.7 acres and a preliminary survey map has been subinitted. Area residents spoke of their concerns regarding the potential negative impact on Little Sissabagama Lake should these lots be developed into 3 parcels. The Board listened to valid points raised by all and agreed that as property owners they have the right to request this rezone when other lots that are now developed were also previously zoned F-1 The Board also understands that the area residents are firmly in objection. Tniked to our attorney and he stnted it more clearly. 1. The Trust is the single sole owner of the Hnthaway Lodge, LLC and Mnrk and I are the Trustees. 2. The ownership of the property remains the Hathnway Lodge, LLC. 3. Prior to Steve's pnssing he nssigned his ownership (he was 100% owner of Hnthnway Lodge, LLC) to the trust (see nttached Assignment of Transferable Interest). Steve remained the manager nnd made me the President of the Hnthaway Lodge, LLC (see attached Amended and Restated Opernting Agreement nnd the Written Action). Since Steve hns passed, we will need to update the Hathaway Lodge, LLC Operating Agreement to reflect Mnrk as Mannger but thnt is not necessary for this proceeding. With that being said however, the Town's opinion does greatly matter when deciding public hearing cases. I tried to convey this to Mr. Baribeau earlier this week. We will be sending this back to the Town for their October Town Board Meeting. The Town has an important role within this zoning process and I must insist that a recommendation for either approval, denial, or table for additional information needs to be made. Use the "findings of facY' including within my staff report as to support a decision but a decision must be made. These requirements are laid out in specific WI Case Law and WI Statutes 59.69(5)(e). I can confirm with the County's legal counsel on this matter but a "no decision" vote leads to a very sticky appeal process and a no decision vote from the Town will most likely result in a "table"from the Sawyer County Zoning Committee until a time that The Town has made a decision. The S/W District overlay is not part of the rezone request and would stay as an overlay. The F-1 zone district requirements would need a minimum of 5 acres and a 300' width requirement. Thus, the zone district change is being requested. With the proposed rezone the applicant would then need to subinit for a certified survey inap which as part of the preliminary map (attached) would have 3 new lakeshore lots on Little Sissabagaina and 1 re�naining lot of approximately 14.2 acres which would stay F-1 . The lake shore lots would vary with meandering frontage but all to be approximately 133' in a right-angle width and over 483' of depth. The Town of Edgewater comprehensive plan future land use shows this area as "shoreland". Shoreland as defined by the Town of Edgewater comprehensive plan still references the old Lake Classification system which is no long in effect. These Lake Classifications were initially intended to protect environmental sensitive bodies of water. This property is located on Little Sissabagama and an unnamed lake whicll were "Wilderness'' bodies of water which would have required a 300' wide lot of water frontage and a �ninimum land area of 5 acres. The Town Comp Plan references only up to the old Class 3 system which would have a minimum density of 1 home per 40,000 square feet of land area and 200' of frontage. The Town Plan further goes on to state, "in some cases, natural features and resources along lakes, rivers, and streams may not be conducive to all types of development. While the future land use map has areas representing the 1,000 foot and 300 foot areas pertaining to development requirements as specified by the lake classification systein,the areas shown do not imply that any and all development types are allowed. Specific review of the areas around lakes, rivers and streams must be perfonned. If the property was rezoned to RR-1 the minimum lot sizes would be 100' of width of frontage and 200' of depth under the new shoreland zoning rules. 4 lake share lots within this area would be extremely difficult and not recominended for that type of condensed development. With the proposed 3 lake shore lots there would be inore rooin as to ensure proper site stability. The surrounding land area is mixed between F-1 and other RR-1 properties with single family dwelling developinent along Little Sissabagama Lake. This is the 2°a reaone request for the property. The previous request last year was to rezone the entire 18.9 acres from F-1 to RR-1 with no future developinent plan. That previous request was approved at the Town and Zoning Coinmittee level but failed final ratification at County Board on a super majority vote in that over 50% of the adjacent property owners filed a petition to protest against the proposed rezone.
