Zoning Administrator Courthouse Hayward, WI 54B43 Dear Mr Heath: In reference to your letter dated August 4 , 1982 I disagree that we are in violation of any zoning ordinance with regard to use or our travel trailer. We have in the past been assured by our attorney Tom Duffy that even if we were not in the process of constructing a dwelling it is perfectly alright to have the trailer there . Nonetheless , we decide3 to go ahead with construction and on January 26 , 1990 were issued the building permit you referenced. Through conversations with you and your staff your office has told me that it would be OK to use the travel trailer as long as we had an active building permit. Acording to your own definition of an active building permit we needed to: - start construction within a year of issue - make progress each ye�r - buildings could be constructed in any order We made a fair amount of progress in the summer of 90 but did not complete so on January 5 , 1991 I wrote to you to see what I had to do to keep the building permit active. Your reply of January 11 , 1991 st.ated that we had satisfied the requirement to start within a year of �ssue and that no extention was necessary to the original permit. (No indication of a need to show cuntinued progress or write to you again the following year. ) In the summer of 91 we moved the trailer back up and made substantial more pr�gress on the buildings covered by the January 1990 permit. Again we did not complete the cabin portion but did essentially complete the Privy and detached garage. Note : The 12 ' X 22 ' detached garage is really what is called the boathouse on the permit. When we decided to make that building large enough to hold a boat we had to move it back, you said that was alright to do that. i , . j i. � This summer we have continued to make some progress . That progress �_ is mostly not visible to casual inspection. The only obvious . progress is extensive cleanup of the site and landscaping . There has , however, been some progress on the main cabin/garage. Most of that work is being stored in the detached garage to protect it from the weather and midnight shoppers . Through conversations with Kurt Kretschmer I knew you were asking about my lack_ of visible progress . For that reason I have tried to contact you many times to discuss what I had done versus what you are aparently expecting. Once was when I applied for my zoning variance , again a week or two later when I was in your office again, once the week after Suly 4 when I was again in your office , (you were in surgery I believe ) and again last week when I called with more questions about my variance application. You are a hard person to get in touch with. Anyway, I will be glad to show you what I have done and talk about what you expect in the way of progress sometime when I am up there . My next trip there will probably bc the weekend of my varia,-ice application meeting . If you need to talk to me before that I can be reached at 507-253-5343 days or 507-367-2463 evenings . I will warn you though that I am about as hard to contact as you are. Anyway, the net here is that I believe I have complied with all your requests and requirements . Therefore I will not be removing my trailer unt.il this fall when I am completed with this years portion of my pro�ects up there. If you have further concern with this after reading this please contact Tom Duffy. Regarding your warriing that it might be difficult to obtain a boathouse zoning variance without making any progress on the dwelling . First of all the footings you saw were for the com�ination garage/dwelling . That is a start. Second, I don't believe there is a requirement to have a dwelling in order to be granted a zoning variance . I can see it would be helpfull to know where the dwelling will be but that is obvious with the footings there . I could understand reluctance to grant a land use� permit for another structure until the dwelling is substantially completed. But, it is not my intention to request any such permit until after the dwzlling currently under construction is substantially completed. I am working on the yariance application now to ensure that I have plenty of time to get that approved. If you or the board would like to make ' substantial completion of the dwelling ' a conditioii of the variance that is fine with me . Feuerstein: On July 29 , 1992 , I visted your property to conduct an inspection required for your upcoming variance application for a 16 ' x 28 ' boathouse. During my inspection, I observed your camper unit parked on the premises . A garge and privy has also been constructed. I also observed that footings have been installed which I assume are for the dwelling . The Land Use Permit you obtained in 1990 covers a boathouse and dwelling with a garage underneath the dwelling . The zoning ordinance requires that the principle strucutre must be started within 12 months after the permit is issued. We wi11 also allow the use of major recreational equipment for housekeeping purposes while the dwelling is being constructed. I believe your permit was taken out in January of 1990 and I believe the footings were poured in the spring of 1991 . It is the intent of the zoning to see progress being made while using the camper. At this time , the footings may have been in place for perhaps one and a half ( 12) years without any further construction taking place. I therefore , have no alternative but to order the camper removed from the premises by August 10 , 1992 . It might also be difficult for you to be granted a variance when you have already constructed the garage , storage building, and privy while making no progress on the dwelling . I will be returning to the property on or about August 12th. I hope I find compliance with my removal order.
