On May 18, 1999, the Sawyer County Board of Appeals approved as amended your variance
on the following described real estate to wit:

and heating costs, reducing the total with the patio only instead of screened in porch will be be-
low 50%, this cost not to be exceeded.
Findings of Fact of the Board of Appeals: There would be no change in the use in the zone dis-
trict. It would not be damaging to the rights of others or property values. It does not increase the
non-conformity of the building.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice.

Variance Application
Dear Mr. Partlow:
I have enclosed the following documents with this letter:
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance - Additional Information," and a completed
• "Variance Application."
Please review the inspection report, read the summary on court decisions and complete
the request for additional information.
While the summary on court decisions pertains only to shoreland properties, the Sawyer
County Board of Appeals may address "reasonable use" of property criteria for any or all
requests for variances that it reviews. Therefore, you must be able to discuss "reasonable
use" as it pertains to your property.
If you believe that you meet the criteria for the requested variance(s), you should review
the variance application for correctness, sign it, and return it to this office with a check in
the amount of $250.00 made out to the "Sawyer County Zoning Administration" by
Thursday, April l , 1999 for hearings in May 1999.
The "Application for Variance - Additional Information" must also be completely filled
out and returned with the Variance Application. Both documents together make up the
entire application that will be reviewed by the Sawyer County Board of Appeals. Failure
to return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your application will be reviewed at two public hearings. The first hearing will held by
the Town of Bass Lake at 6:30 P.M., Monday, May 10, 1999. You should contact Shirley
Miller, Clerk, Town of Bass Lake at (715) 634-2172 to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday,May 18,1999 in the Circuit Courtroom located in the Sawyer County
Courthouse.You or your representative should attend each heazing,especially the hearing
conducted by the Sawyer County Board of Appeals.Only the Board of Appeals can grant
the variance,the decision of the Town of Bass Lake is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance(s)that you
have requested.Therefore,you should consider using any means at your disposal(i.e.,
photographs,drawings,a good verbal presentation,etc.)as you present your facts to the
Board.
The"50%rule"applies in this situation as the cabin is a nonconforming structure-it is
closer than 75'to Durphee Lake,30'to the center of the access road and 40'to the
wetlands behind the cabin. The"50%rule"limits the cost of improvements to a
nonconforming structure to less than 50%of the structure's cunent estimated fair market
value(CEFMV). The Sawyer County Board of Appeals must approve a variance if the
cost of these improvements will exceed 50%of the CEFMV. The CEMFV for the house
is$22,400.00. Therefore,a variance would be required if the cost of the improvements
would exceed$11,200.00.Mr.Scidmore,your builder,assures me that the cost of the
improvements will exceed$11,200.00.
You must also provide this office with a written estimate of the material and labor costs
for the additions and the change in the roofline.The estimate should include only the cost
of materials and labor related to enclose the additions,finish the interior of the additions
and construct the roof.Do not include costs for plumbing,electrical wiring,carpeting etc.
The construction cost estimates shall be in this office no later than Friday,Apri130, 1999.
It would be even better if you could submit the estimates with the signed variance
application.You may also want to provide this information to the Town of Bass Lake.

To Whom it May Concern:
Enclosed please find a completed Variance Application along with additional information
regarding the 50% Rule and the 30 ft. to the Center of the Access Road.
The 50% Rule
Mr. Dale Scidmore has provided me with an estimate for the cost of the bedroom and
bath. Dale's estimate including labor and materials is $13,900. This amount includes
costs (labor & materials) for plumbing, electrical wiring and flooring. Subtracting these
amounts would put the total below $11,200. I have also enclosed my own breakdown
for materials that would place me far below Dale's estimate. In addition, I plan to work
with Dale on this project further reducing the cost of construction.
The second proposed improvement is for the front portion of the cabin. I'd like to
remove the existing shed style (flat) roof and peak it to match the existing roofline and
reconstruct the walls; this improvement would eliminate the current leakage that occurs
from insignificant rain and snow runoff. This improvement would also help in the
insulation and provide improved interior and exterior aesthetics.
The final improvement concerns the construction of a screen porch on the NE corner.
This improvement would allow all rooflines to match and create a more uniform look to
the exterior of the cabin while providing a relaxing atmosphere. Labor and materials for
this improvement would be minimal; the new windows have been acquired and 1 would
supply the labor.
30 Ft. to the Center of the Access Road
According to the Certified Survey Map (enclosed), the current road ends at the beginning
of my lot line. My neighbor, Mr. Lauren Wical who owns both cabins west of mine has
his own road off of Durphee Lane that runs to the west of his property line.

I have reviewed the proposal by James R.Partlow for a variance from Section 10.2 of the Sawyer County
Ordinance which restricts the cost of construction to less than 50%of the current estimated fair muket value,
and a variance from Section 4.49(1),which would require a setback of 40 feet from the wetland,and a variance
from Section 4.49(2),which would require a lake setback of 40 feet as the average lake setback.The request is
for the construction of a ]0'x 26'addition,including a screen porch and the razing and reconstruction of a 7'8"
x 22'portion of the dwelling with a new roof extended from the existing roofline at a setback of 27.5'.
The basic purpose of the shoreland zoning ordinance is to protect navigable waters from degradation and
deterioration which results from uncontrolled use and development of shorelands. According to Wisconsin case
law,re-affirmed in the recent Wisconsin State Supreme Court decision State of Wisconsin v.Kenosha Countv
Board of Adiustment,when an applicant submits a request for a variance,he or she must show that unless a
variance is granted,he or she has no reasonable use of the property.
In other words,the party seeking the variance must prove that an unnecessary hazdship will result if the variance
is not granted. The hardship must be the result of a unique condition of the property or land,and not a
condition personal to the landowner. The granting of a vaziance cannot be to alleviate(or accomodate)a self-
created hardship,or merely for self-convenience. See also,Section 59.694(7),Wisconsin Statutes.
Mc Partlow is proposing a project that requires four variances from the Sawyer County Zoning Ordinance.It is
apparent that for this building site,only the minimum relief should be requested.The Partlows'do have
rea�onable use of the property without the addition of an unnecessary accessory sir�cture such as a porch.
Proposal 1 without the porch addition would be preferable to Proposal number 2.
The granting of vaziances from the 50%rule undermines the intent of shoreland zoning and will have a
detrimental cumulative impact.
After reviewing the request by Mr. Partlow,the Department believes that none of the above criteria are met and
recommends that the board deny the request.Thank you for the opportunity to comment on this proposal.
