Mr. Mark Curtis, Northland Recreational Homes, Inc. accompanied me on the inspection. The average lake setback was determined to be at 53' from Sand Lake. A flag was set at this distance from the lake. The cabin is located 41' from the lake. The prior approval of a variance by the Saw}�er County Board of Appeals would be required to construct an addition closer than 53' to the lake. The parcel appears to be approximately 95' wide. The required parcel width for a conforming lot is 100 feet with a minimum area of 20,000 square feet. Therefore your parcel is nonconforming for lot width. The required lot line setbacks are a minimum of 10' from one lot line and 30' from the opposite lot line. The cabin appeazs to meet these setbacks. The 50% of Current Estimated Fair Market Value (CEFMV) rule applies in this situation as the cabin is a nonconforming structure, it is located closer than 75' to the lake. The 50% rule restricts the costs of improvements to a non�pnforming structure to less than 50% of the structure's CEFMV. The CEFMV for the cabin is $35,200; therefore, the 50% CEFMV is $17,600. The prior approval of a variance for the 50% CEFMV rule must be obtained if the construction costs would exceed $17,600. There is sufficient area behind the cabin to construct a new dwelling 75' from the lake. The primary advantage of building 7S from the lake is that a confarming dwelling would be created in that it would be 75' from the lake. However, a variance would still be required for lot width. The Board of Appeals would probably grant this variance as it would result in a dwelling at least 75' from the lake. The difficulty in building 7S from the lake would be locating an area for a septic system. The area between the cabin and West Shore Lane is low and there may be a high ground water problem. However, there may be an azea for a septic system on the knoll where the cabin is now located. Mr. Curtis informed me that construction costs for renovating the cabin would exceed $100,000. The Boazd of Appeals may decide that if you will be spending that much money ($100,000) on renovating a small cabin (CEFMV of$35,200) with the end result that the existing cabin will really cease to exist, that you should construct a new dwelling at least 75' from the lake. Again, the Board would probably be willing to grant a lot width variance to allow you to build at 75' from the lake. Please contact the office if you have any questions or comments.
